A representative of the Traffic Police Department confirmed that the information that Decree 168/2024/ND-CP was built with incorrect procedures is incorrect. Due to the urgency, the competent authority held a meeting to consider and decide to issue the decree according to the shortened procedure.

Decree 168/2024/ND-CP officially takes effect from January 1, 2025

In recent days, social networks have been spreading information that "Decree 168/2024/ND-CP was built with incorrect procedures because from the date of signing to the date of taking effect, less than 45 days have passed."

Regarding this issue, a representative of the Traffic Police Department (Ministry of Public Security) confirmed that this information is incorrect.

Decree 168/2024/ND-CP stipulates administrative sanctions for violations of traffic order and safety in the field of road traffic; deduction and restoration of driving license points.

The Decree was signed and issued on December 26, 2024, and will take effect from January 1, 2025. Some regulations on child safety equipment in cars (Point m, Clause 3, Article 6); commercial vehicles transporting preschool children... (Point e, Clause 4, Article 26 and Point b, Clause 1, Article 27) will take effect from January 1, 2026.

At the same time, regulations on emission inspection certificates for motorbikes and scooters will take effect according to regulations of environmental protection law on emission inspection for motorbikes and scooters.

According to a representative of the Traffic Police Department, during the process of drafting Decree 168 to replace Decree 100/2019/ND-CP (amended and supplemented in Decree 123/2021/ND-CP), due to the urgent nature related to the traffic order and safety situation, the competent authority held a meeting to consider and decide to issue the decree according to the shortened procedure.

Article 151 of the Law on Promulgation of Legal Documents stipulates that legal documents promulgated under simplified procedures may take effect from the date of adoption or signing. Meanwhile, Decree 168, which serves the implementation of the Law on Road Traffic Order and Safety, will take effect from January 1, 2025.

In addition to increasing penalties for many intentional and dangerous acts, the decree also clearly stipulates the deduction of driving license points as stipulated in the law.

"After about 5 years of implementing Decree 100, in reality, factors have arisen that require more appropriate legal regulations to ensure traffic order and safety," according to a representative of the Traffic Police Department.

Because the decree has a great impact, to ensure quality, the functional units of the Ministry of Public Security have coordinated with relevant ministries, branches and agencies to discuss thoroughly. At the same time, the draft decree was also posted and widely consulted according to regulations on the Ministry of Public Security's Electronic Information Portal and the Government Electronic Information Portal.

Previously, Decree 100 was also issued under simplified procedures. This Decree was issued on December 30, 2019 and took effect from January 1, 2020 to comply with the Law on Prevention and Control of Alcohol Harm in 2019.
