On the morning of February 14, the National Assembly Standing Committee reviewed and approved the draft Resolution guiding the implementation of the National Assembly Session Regulations.
The issuance of the Resolution is urgent and necessary.
Presenting the Draft Resolution, Secretary General of the National Assembly and Head of the National Assembly Office Bui Van Cuong affirmed that the issuance of the Resolution is urgent and necessary, in order to promptly implement Resolution No. 71/2022/QH15 of the National Assembly, effective from March 15, 2023.
Including the National Assembly Standing Committee providing guidance on the organization of extraordinary sessions and online meetings, combining in-person and online meetings; providing guidance on the dossiers of candidates nominated and self-nominated for positions to be elected or approved by the National Assembly; voting rules, ballot forms, vote counting minutes, minutes of secret ballot results, minutes of sealed ballots; sample submission forms, minutes of meetings of the National Assembly delegation, minutes of vote counting for the election of the Head of the National Assembly delegation, Deputy Head of the National Assembly delegation at the first session of each National Assembly term.
The Draft Resolution consists of 5 Chapters with 19 Articles.
To ensure consistency, the Secretary General of the National Assembly proposed that this Resolution take effect from March 15, 2023, at the same time as Resolution No. 71/2022/QH15 promulgating the Rules of the National Assembly session.
Reporting on the draft Resolution, Chairman of the National Assembly's Law Committee Hoang Thanh Tung said that the Standing Committee of the Committee basically agreed with the name, scope of regulation and content of the draft Resolution.
Regarding the content to be submitted to the National Assembly at the extraordinary session, the majority of opinions in the Standing Committee agreed that the draft Resolution does not limit the issues and content to be submitted to the National Assembly at the extraordinary session to ensure compliance with the provisions of the Constitution, the Law on Organization of the National Assembly and the Rules of the National Assembly session.
"In case the President, the National Assembly Standing Committee, the Prime Minister or at least one-third of the total number of National Assembly deputies request, the National Assembly shall hold extraordinary meetings to discuss and decide on issues within its tasks and powers, except for the contents periodically submitted to the National Assembly as prescribed by law."
In addition, some opinions suggested that more specific guidance is needed on the criteria for determining the content to be submitted to the National Assembly for consideration and decision at an extraordinary session to suit the purpose and requirements of holding an extraordinary session, which is to only handle major, important, urgent issues, and the time for holding an extraordinary session is often very short.
Specifically, only include in the agenda of the extraordinary session those contents that ensure the following criteria and conditions: are important and urgent contents within the tasks and powers of the National Assembly, have been carefully prepared and have basically reached consensus between the submitting agency and the reviewing agency; to promptly implement the request of the competent authority; and are not part of the contents periodically submitted to the National Assembly according to the provisions of law.
The Standing Committee of the Law Committee agreed with the provisions of the draft Resolution on people invited to attend and listen to the National Assembly session held in the form of online meetings and said that the expansion of the provisions allowing "Representatives of a number of state agencies, political organizations, socio-political organizations, social organizations, people's armed forces units, press agencies of provinces and centrally run cities to be invited to listen to public sessions of the National Assembly at the bridge point in that province or centrally run city" is consistent with the implementation in the past and with the provisions of the National Assembly Session Regulations (citizens can listen to public sessions of the National Assembly).
Carefully review personnel records regulations
At the meeting, members of the National Assembly Standing Committee assessed that the process of preparing and completing the draft Resolution dossier was carried out carefully.
The basic documents are complete according to regulations, ensure quality and are qualified for the National Assembly Standing Committee to consider and approve, ensuring that this document is issued and takes effect at the same time as Resolution No. 71/2022/QH15.
Chairwoman of the National Assembly's Judiciary Committee Le Thi Nga said it is necessary to stipulate criteria for the content of extraordinary sessions to avoid the situation where a normal session cannot be completed in time and then it is transferred to an extraordinary session.
Therefore, the content of the extraordinary meeting must have criteria, which are important and urgent issues that cannot wait until the normal meeting to be included.
Concluding this content, Permanent Vice Chairman of the National Assembly Tran Thanh Man emphasized that the National Assembly Standing Committee agreed on the extraordinary session, agreeing with the provisions as in the draft Resolution. This includes specific provisions on how to handle requests from competent entities regarding the organization of extraordinary sessions according to the provisions of the Constitution, the Law on the Organization of the National Assembly, and the Rules of the National Assembly session.

The Draft Resolution stipulates the order and procedures for reviewing and deciding on contents at extraordinary sessions, which are implemented in accordance with relevant legal provisions on National Assembly sessions.
Regarding personnel records and secret ballot procedures, the Standing Vice Chairman of the National Assembly proposed a thorough review of regulations on personnel records introduced by competent agencies or individuals for the National Assembly to elect and approve positions in the State apparatus, and other documents in the records submitted to the National Assembly for the dismissal of National Assembly deputies, the dismissal of National Assembly deputies, the dismissal, removal, and approval of proposals for dismissal or removal of people holding positions elected or approved by the National Assembly.
The Standing Vice Chairman of the National Assembly also proposed to review the secret ballot regulations at the National Assembly, invalid ballots, ballot samples or approve the vote counting minutes, voting results minutes, ballot sealing minutes, meeting minutes and vote counting minutes for the election of the Head of the National Assembly Delegation and Deputy Head of the National Assembly Delegation at the first session of each National Assembly term to ensure consistency and compliance with Party regulations and laws.
At the meeting, the National Assembly Standing Committee voted to pass the Resolution guiding a number of articles of the National Assembly Session Regulations with 100% of the delegates present in agreement.
The Standing Committee of the National Assembly assigned the Standing Committee of the Law Committee to preside over reviewing, absorbing, revising and finalizing the draft Resolution based on opinions at the meeting, sending it back to the Standing Committee of the National Assembly for written comments to ensure consistency and submit it to the Chairman of the National Assembly for signing and promulgation.
In this morning's meeting, the National Assembly Standing Committee also voted to approve the draft Resolution on the tasks, powers, structure and organization of the Secretariat of the National Assembly Standing Committee.
