Kinh Mon removes 'bottleneck' to clear violations at Lim Mountain mine

The hot spot of land law violations at Lim Mountain Mine, Phu Thu Ward (Kinh Mon, Hai Duong) with a large area and long duration has been untied.

"Genie" moves house

During this time, every day at Mr. NVPh.’s family, in Lim Mountain Mine, Phu Thu Ward (Kinh Mon), there are about 10 people digging the foundation of the house. These are workers from Cam Luy Construction - Relocation - Elevation - Anti-tilt Company Limited (a unit known as the “genie” in Ho Chi Minh City) moving Mr. Ph.’s house from the violation area to the family’s legal residential land. The new location is more than 10 meters away from the old location.

Mr. Huynh An Tri, technical officer, Project Manager (Cam Luy Construction - Relocation - Elevation - Anti-tilt Company Limited) said that normally to relocate a house, the following steps need to be taken: pre-construction of the foundation system for the structure at the required location; construction of a road for the structure to move to the new location; separation of the entire structure from the old foundation structure and placement on a steel wheel system or on a roller system for relocation; use a hydraulic push system to move the structure to the desired location; connection of the entire structure to the new foundation system.

“Because the foundation and the beam of Mr. Ph.’s house are attached to each other, we need to make an additional fake foundation for the house in its current location so that the house has a support and does not sink. After that, we will make the foundation in the new location. The fake foundation also has the function of bringing in the sliding system and rollers to move the house…”, Mr. Tri said.

According to Mr. Tri, in about 2 months, the preparation work will be completed before the house can be moved to a new location and the entire structure will be connected to the new foundation system.

A relative of Mr. Ph. said that Mr. Ph.'s family had carefully researched information on the internet about house relocation. Instead of demolishing the house, the family sought a relocation method to minimize damage. According to an official of Phu Thu Ward, during the house relocation process, Mr. Ph. was also supported by the Ward People's Committee with 2 trucks to transport soil and 2 excavators.

In the Lim Mountain area, there are 3 households violating land laws. In addition to Mr. NVPh.’s household, which is currently relocating, 2 other households, including Mr. NVP and Mr. NVT, have completed dismantling their illegal constructions by March 10.

“This is an unexpected result of the local government in handling land violations in the Lim Mountain mine area,” said Mr. Bui Xuan Loc, Deputy Secretary of the Town Party Committee and Chairman of the Kinh Mon Town People's Committee.

Propaganda and mobilization efforts

The above results were achieved thanks to the propaganda and mobilization work of local Party committees and authorities. At first, organizations and unions repeatedly visited each house to mobilize, but some households did not cooperate. The violation area was large, the violation time was long, especially the amount of property on the violated land area was very large, causing households to be somewhat sluggish. This was the "bottleneck" leading to difficulty in resolving violations.

On February 12, the People's Committee of Kinh Mon town issued a plan to enforce remedial measures against 3 families who violated land regulations at Lim Mountain Mine. According to the plan, from February 12 to 18, the People's Committee of the town organized 4 propaganda and mobilization campaigns. In reality, there were many more propaganda and mobilization campaigns. Sometimes, the working groups had to spend the whole evening meeting with the households because they were just home at that time.

Mr. Bui Xuan Loc added that propaganda and mobilization work must be done in a reasonable and appropriate manner. First of all, each officer performing the task needs to put himself in their position before applying the provisions of the law to explain to them.

There have been cases where Mr. Loc personally met with us to lobby. “Although we are flexible, we still have a clear point of view. Violations must be handled according to regulations. However, it cannot be denied that these violations are the result of lax management from the grassroots level to the responsibility of departments and offices in the town,” Mr. Loc said.

On the evening of February 18, the above households agreed to sign a petition to voluntarily dismantle and relocate illegal constructions according to regulations. On the morning of February 19, the households simultaneously dismantled and relocated the illegal constructions. Mr. NVP and Mr. NVT's households dismantled all houses, surrounding walls, trees, and assets from the illegal land area. Mr. NVPh's household requested to relocate all houses to legal residential land. The voluntary dismantling and relocation of illegal constructions by the households helped the local authorities reduce pressure in the process of clearing land violations here.

Previously, Mr. NVPh.'s family had 241 m² of land adjacent to Lim Mountain Mine. In 2015, Mr. Ph. encroached on an additional 421 m², built a 3-storey house, 94 m² of reinforced concrete frame, 2 temporary level 4 houses, yard, garden, pond.

Mr. NVP has 92.1 m² of land adjacent to Lim Mountain Mine. In 2019, Mr. P. encroached on an additional 7,547 m², building a 1-storey house with an area of ​​315 m² of reinforced concrete frame. On this encroached land area, Mr. P. also built a yard, fish pond, garden, etc.

Next to Mr. P.'s house is the land that Mr. NVT (Mr. P.'s nephew) encroached on, covering an area of ​​1,663 m². In 2016, Mr. T. built a 1-storey house, 172 m² wide, with a reinforced concrete frame; yard, garden, pond... on this encroached land.
