Lim Mountain Mine, Phu Thu Ward is one of the hot spots for land law violations in Kinh Mon Town (Hai Duong). In this area, there are 3 households encroaching on nearly 1 hectare of land, which has been going on for a long time.

Encroachment on 9,631 m² to build a solid house

Mr. NVP has 92.1 m² of land adjacent to Lim Mountain Mine. In 2019, Mr. P. encroached on an additional 7,547 m², building a 1-storey house with an area of ​​315 m² of reinforced concrete frame. On this encroached land area, Mr. P. also built a yard, fish pond, garden... estimated to be worth several billion VND. This is the largest encroachment case in the Lim Mountain Mine area.

Next to Mr. P.'s house is the land that Mr. NVT (Mr. P.'s nephew) encroached on, covering an area of ​​1,663 m². In 2016, Mr. T. built a 1-storey house, 172 m² wide, with a reinforced concrete frame; yard, garden, pond... on this encroached land.

In addition to Mr. P. and Mr. T., Mr. NVPh also encroached on land in the Lim Mountain mine area. Mr. Ph.'s family has 241 m² of land adjacent to the Lim Mountain mine. In 2015, he encroached on an additional 421 m², built a 3-storey house, 94 m² of reinforced concrete frame, 2 temporary level 4 houses, yard, garden, and pond.

Thus, within 4 years, the above 3 households encroached on a total of 9,631 m² of land in the Lim mountain mine area.

Most of the land encroached upon by households is within the mineral exploitation area of ​​Phu Tan Company Limited (address: Chau Xa residential area, Duy Tan ward). The enterprise was granted a mineral exploitation license No. 2888/GP-UBND by the Provincial People's Committee on August 23, 2006 to exploit hilly land for construction materials, with an area of ​​21,050 m², exploitation period of 5 years.

At the time the households encroached on the land, Phu Tan Company had expired its mining license and was carrying out procedures to close the mine. The households knew that the land was leased by the State to Phu Tan Company for mining, but they still deliberately violated the law. At that time, Phu Tan Company sent a document to the police and the People's Committee of Phu Thu Ward requesting support to resolve the issue.

By December 4, 2023, the Provincial People's Committee issued Decision No. 2840/QD-UBND on the partial closure of the Lim Mountain Mine mineral exploitation area. The closed area is 6,662 m². Phu Tan Company Limited has completed the workload according to the project to partially close the mine; renovate and restore the environment according to the approved plan.

The remaining area of ​​the Lim hill mine mineral exploitation area cannot be closed due to violations by the above households.

Will be forced to evacuate

On October 10, the Provincial People's Committee issued a decision to force the implementation of remedial measures against Mr. NVP's family.

In addition to the limited awareness of compliance with legal regulations of households, the cause of land violations in Lim Mountain is also due to the local government's lack of determination to prevent violations. At the time of detecting households violating the law, the People's Committee of Phu Thu Ward organized propaganda and mobilization, but only stopped at making records of administrative violations in the field of land, records of suspension of land use violations, and did not issue administrative sanctions. The People's Committee of the Ward did not report to the People's Committee of the town for timely handling.

Mr. Nguyen Van Cuong, Permanent Vice Chairman of Kinh Mon Town People's Committee, said that this is also part of the responsibility of the Town People's Committee and specialized departments and offices in land management.

Based on the time of violation and the level of violation, the authority to handle the violation of the households will belong to the Provincial People's Committee or Kinh Mon Town People's Committee. All 3 cases of violation have now expired the statute of limitations for handling administrative violations, therefore, the Provincial People's Committee and Kinh Mon Town People's Committee have not issued decisions to handle administrative violations.

On October 10, the Provincial People's Committee issued a decision to force Mr. NVP's family to take remedial measures. Specifically, Mr. P. was forced to demolish his house, relocate crops and aquatic products, restore the original state, and return 7,547 m² of land to the local government. Mr. P. was forced to return the illegal profits gained from land encroachment of VND 19,726,000.

Also on October 10, the People's Committee of Kinh Mon town issued a decision to force Mr. NVT and Mr. NVPh to take remedial measures. Specifically, Mr. T. and Mr. Ph. were forced to demolish their houses and move all crops and assets on the land out of the violated land area. Mr. T. returned 1,663 m² of land; Mr. NVPh returned 421 m² of occupied land to Phu Tan Company Limited to carry out related procedures according to legal regulations.

During this time, the People's Committee of Phu Thu Ward and the People's Committee of Kinh Mon Town organized many propaganda, mobilization and explanation campaigns to help households understand the regulations.

According to Mr. Nguyen Van Cuong, Permanent Vice Chairman of Kinh Mon Town People's Committee, after 30 days from the date of delivery of the decision, if households do not voluntarily dismantle the violating constructions, the Town People's Committee will carry out enforcement and completely resolve the violations.
