Handling violations of land and construction order along Truong Chinh Street (Hai Duong City)

Comrade Luu Van Ban, member of the Provincial Party Standing Committee, Permanent Vice Chairman of the Provincial People's Committee requested a comprehensive review of all land lots along Truong Chinh Street. This street lacks architectural planning, leading to illegal construction. The Departments of Planning and Investment, Natural Resources and Environment, Construction, Justice and Hai Duong City People's Committee compared legal regulations and clarified the basis for granting land use right certificates and investment and construction licenses here. While waiting for written responses from specialized agencies, Hai Duong City People's Committee did not carry out licensing procedures in this area. Based on the clarification of previous licensing procedures and processes, the provincial advisory agencies coordinated with Hai Duong City to assess the current situation and determine the causes of violations to propose appropriate solutions.

According to the detailed planning for the construction of the Commercial, Tourism, Cultural and New Urban Area in the west of Hai Duong City, the land fund on both sides of Truong Chinh Street has the function of constructing mixed commercial and service buildings. The number of floors of the building is from 5-7 floors, the construction density is from 35-60%, the construction boundary distance from the red line to each plot of land is regulated from 3-8m. Through the review of the People's Committee of Hai Duong City, along Truong Chinh Street, there are 105 plots of land in Thanh Binh, Tan Binh and Tu Minh wards. Currently, there are 40 plots of land that have not been constructed, some of which are only 1-2 floors, not ensuring the number of floors according to the planning. The plots of land here are identified as commercial and service land but are granted long-term land use right certificates.
