The National Assembly decided to absolutely ban alcohol concentration for vehicle drivers when passing the Law on Road Traffic Safety and Order on the morning of June 27.

Article 9 of the Law states prohibited acts, including driving a vehicle on the road while having alcohol in the blood or breath.

In the previous report on receiving explanations, Chairman of the National Defense and Security Committee Le Tan Toi said that the absolute ban on alcohol concentration is not new content, inherited from the 2008 Road Traffic Law and consistent with the Law on Prevention and Control of Harmful Effects of Alcohol and Beer.

On June 21, the National Assembly Standing Committee asked for the opinions of delegates via electronic ballot. As a result, 293/388 delegates participating (75.52%) agreed to prohibit driving vehicles on the road with alcohol concentration in blood or breath. 95 delegates (24.48%) proposed a minimum limit for alcohol concentration and 8 delegates had other opinions.

On this basis, the National Assembly Standing Committee believes that continuing to completely ban alcohol concentration is to best protect people's lives, health, and property, protect social resources, and protect the longevity of the race. To form a traffic culture of "don't drive after drinking alcohol". After that, we will summarize, propose regulations or amend and supplement them to suit the practical situation.

Regarding the case of not drinking alcohol or beer but still having alcohol concentration in the blood, taking into account the opinions of delegates, the National Assembly Standing Committee has directed to supplement the draft provision assigning the Ministry of Health to regulate how to determine alcohol concentration and endogenous alcohol concentration in the blood.

Use part of the fine money to ensure traffic safety

In Article 4 of the draft, the State allocates corresponding amounts from the amount of fines for administrative violations of road traffic order and safety and the amount of money from auctioning license plates after being submitted to the state budget to strengthen and modernize facilities and vehicles, ensuring security, order and traffic safety.

Explaining this content, the National Assembly Standing Committee said that in recent years, the National Assembly has allocated the budget in the direction of arranging the budget expenditure estimate for 100% of the revenue from administrative fines for violations in the field of road traffic safety after submitting it to the state budget.

The allocation rate for the Ministry of Public Security and localities depends on the needs of each year, but the implementation process is difficult because it is not yet regulated by law. Up to now, the budget for handling administrative violations in 2024 has been decided by the National Assembly, but has not yet been allocated due to the lack of specific guidance documents on this content.

After the Law is passed, the Government must issue documents to specify the subjects of application, subjects to be arranged, items to be arranged, use of funds, preparation of estimates, allocation of estimates and settlement of allocated funds on the basis of compliance with the provisions of the law on the state budget to facilitate and unify the implementation process.

Deduct license points from offending drivers

In Article 58, the Law stipulates that driving license points are used to manage drivers' compliance with laws on road traffic order and safety. The number of points deducted for each violation depends on the nature and severity of the behavior.

The data on the driving license deduction points of the violator will be updated into the database system immediately after the penalty decision comes into effect. The driving license will be restored with 12 points if all points have not been deducted and no points have been deducted within 12 months from the date of the most recent deduction.

Mr. Le Tan Toi said that the regulation on points and deduction of points from driving licenses is a measure to manage drivers' compliance with the law in order to raise awareness of law compliance and prevent violations.

The National Assembly Standing Committee believes that the deduction of points does not have a punitive effect and is therefore not an additional form of administrative penalty. The authority to test knowledge of traffic safety laws is appropriate for the Traffic Police, because this force is responsible for managing people after they are granted a driving license.
