This morning, the Government Inspectorate held a national online conference to review 5 years of implementing the Law on Anti-Corruption.

Recommendations on promoting the role of society in preventing and combating corruption

Presenting the interim report, Deputy Inspector General of the Government Le Tien Dat stated that the results achieved after 5 years of implementing the Law on Anti-Corruption and its guiding documents, the work of anti-corruption has achieved many positive results.

In particular, the work of inspecting and supervising the implementation of the code of conduct of cadres, civil servants and public employees in the performance of their duties, public service and in social relations has been of interest and focus to ministries, branches and localities. Agencies, organizations and units have developed plans and organized the implementation of job transfers of people with positions and powers according to the provisions of the Law on Anti-Corruption and guiding documents.

235,271 civil servants and public employees have changed their positions to prevent corruption... Ministries, branches, localities, and agencies controlling assets and income have also actively implemented Party regulations and State laws on controlling assets and income.

In the 5 years (2020-2024 period), 2,060,550 people declared their assets and income during the period, with a disclosure rate of over 98%; 37,106 people had their assets and income verified; 147 people were disciplined for violating regulations on asset and income control.

The work of detecting and handling corruption has made great strides and breakthroughs. The authorities have been proactive, focused on verifying, tracing and effectively implementing the recovery of misappropriated and lost assets. The recovery rate has been high. The cases brought to trial ensure the right people and the right crimes are highly appreciated by public opinion and the people.

Ministries, branches, localities, relevant agencies, organizations and units continue to strictly implement Party regulations and State laws on the responsibility of leaders in the work of preventing and combating corruption and negativity; promptly dismiss and replace disciplined officials, those with limited capacity and reduced prestige...

During the 2020-2024 period, 264 leaders and deputy leaders were disciplined for lack of responsibility for corruption; 73 people were criminally prosecuted for lack of responsibility for corruption.

In addition, the operational efficiency of specialized anti-corruption units has been increasingly improved. The prevention and fight against corruption in enterprises and non-state organizations, and the role and responsibility of society in preventing and fighting corruption have been enhanced.

However, corruption is still very complicated with serious nature, amount of corrupt assets and positions and powers of those who commit corrupt acts. The effectiveness of implementing corruption prevention measures is still limited; the rate of recovery of corrupt and lost assets is still low; the value of assets to be recovered in corruption and negative cases is still large. Legal regulations on handling people who commit corrupt acts are not strong enough, do not have enough sanctions and deterrence, so they have not really promoted effectiveness in corruption prevention work.

At the conference, delegates discussed the Central Government's guidelines, policies and directions in the work of preventing and combating corruption and negativity; the work of detecting, prosecuting and investigating corruption crimes; the work of preventing, detecting and handling corruption...

According to Vice Chairman of Hanoi People's Committee Le Hong Son, although the system of legal regulations has been paid attention to and completed, there are still some shortcomings and problems, some of which are not specific, coherent and unified, and there is a lack of detailed guidance documents to promptly adjust some issues arising in practice, leading to difficulties and confusion in implementation. In particular, Hanoi People's Committee recommends that the Government Inspectorate soon issue a Circular guiding the implementation of asset and income control, and at the same time soon complete the national database system on asset and income control...

To enhance the role of society in the fight against corruption, according to Ms. Nguyen Quynh Lien (Head of the Department of Democracy, Supervision and Social Criticism, Central Committee of the Vietnam Fatherland Front), State agencies need to be aware of the role and importance of society in this work, the great impacts and effectiveness of mobilizing a large number of political-social organizations, social-professional organizations and the masses to participate in supervision; detect and denounce acts of corruption in the public apparatus. Each social organization and citizen must also clearly see their responsibilities and roles, and voluntarily and responsibly exercise their rights and obligations in this arduous struggle.

Next is to perfect policies and laws to promote the role of society in preventing and combating corruption, with specific regulations so that the Fatherland Front, socio-political organizations, professional organizations, businesses, the press and people can proactively participate, avoiding the situation where they only participate when assigned a task or are "invited".

Speaking at the conference, Government Inspector General Doan Hong Phong emphasized that after more than 5 years of implementing the Law on Anti-Corruption, the work of anti-corruption has been deployed strongly, resolutely, persistently, continuously, without rest, without forbidden areas, without exceptions, regardless of who the person is. The work of anti-corruption has achieved important, comprehensive, synchronous and more obvious results. Corruption has been gradually controlled, prevented and tends to decrease.

The Inspector General raised a number of cases that received special attention from the public, such as Van Thinh Phat, AIC, Phuc Son, Thuan An, etc. These cases clearly demonstrate the viewpoint of "very high political determination, strong and innovative actions, no forbidden areas, no exceptions".

In addition to the achievements, the Inspector General acknowledged that the work of preventing and combating corruption and negativity in recent times still has shortcomings and limitations. In particular, mechanisms, policies and laws in some areas still have loopholes and inadequacies, which can easily be exploited for corruption and negativity.

To promote the achieved results and overcome shortcomings and limitations, the Inspector General believes that it is necessary to focus on perfecting the mechanisms, policies and laws on corruption prevention and control. In addition to amending and supplementing the provisions of the Law on Corruption Prevention and Control that are still inadequate, it is necessary to continue perfecting the mechanisms and policies on socio-economic management. This is to ensure consistency, synchronization, strictness, no loopholes, shortcomings, and no subjects taking advantage of corruption and negativity. Until the law is amended, it is necessary to continue to strictly implement the Law on Corruption Prevention and Control, including synchronously implementing solutions to prevent corruption; strengthening the work of detecting, handling corruption, and recovering corrupt assets.

Inspection, examination, auditing, investigation, prosecution, trial and execution agencies need to pay attention to perfecting their organization, apparatus and arranging forces to ensure good implementation of corruption prevention and control work.

Regarding the Inspectorate, Mr. Doan Hong Phong emphasized that it is necessary to continue to improve the effectiveness of state management in preventing and combating corruption; to conduct inspections and examine the responsibilities of heads of state management agencies in implementing laws on preventing and combating corruption. It is necessary to strengthen the detection and handling of corruption through inspections, especially promptly transferring cases with signs of crime to the investigation agency.

In addition, continue to promote the role of society in preventing and combating corruption; strengthen the supervision activities of the National Assembly, People's Councils and the Fatherland Front on preventing and combating corruption.
