The Politburo clearly stipulates the protection and prohibited acts in protecting those fighting against corruption, waste and negativity.
The Politburo has just issued Regulation 231-QD/TW on protecting people fighting against corruption, waste and negativity.
How are those who fight against corruption, waste and negativity protected?
The regulation clearly states that a person fighting against corruption, waste and negativity is an individual who reflects, denounces and denounces acts of corruption, waste and negativity of agencies, organizations and individuals in performing assigned tasks and public duties, in managing and using public finance and public assets.
People fighting against corruption, waste, negativity and their relatives (wife/husband, biological father, biological mother, adoptive father, adoptive mother, biological child, adopted child) have their identity and other personal information protected; their life, health, property, honor, dignity, work position, employment; and other legitimate rights and interests as prescribed by law.
People fighting against corruption, waste and negativity have the right to know about protection measures; rights and obligations when protection measures are applied; to request changes, additions or termination of the application of protection measures; to refuse to apply protection measures; to be compensated according to the provisions of law on State compensation liability when competent authorities do not apply protection measures or do not apply them in a timely manner, causing damage to the life, health, property or spirit of people fighting against corruption, waste and negativity or their relatives.
Regarding responsibility, the Politburo stipulates that those fighting against corruption, waste, and negativity must comply with regulations on handling and resolving feedback, accusations, and denunciations of corruption, waste, and negativity; and must not affect the legitimate rights and interests of organizations and individuals.
At the same time, comply with the requests of competent agencies, organizations and individuals in protecting and providing information and documents related to the content of the fight against corruption, waste and negativity, and at the same time be responsible for the accuracy and honesty in providing information and documents to fight against corruption, waste and negativity.
Provide the basis (if any) to determine whether you and your relatives have been threatened, persecuted, retaliated against or have had your legitimate rights and interests violated.
Comply with the final settlement conclusions of competent organizations, agencies and units and other relevant Party regulations and State laws.
In case of no protection, termination of protection
The regulation clearly states 4 cases of non-protection and termination of protection when the protected person has a written request for termination, refuses to apply protection measures, does not cooperate with competent authorities in the process of implementing the request for protection or does not comply with the obligations as prescribed.
The content of the fight against corruption, waste and negativity has been examined, verified and concluded by competent authorities to be baseless and untrue.
The basis for applying protective measures no longer exists.
There are also other cases of non-protection and termination of protection according to Party regulations and State laws.
Prohibition of rotation and mobilization of people fighting against corruption, waste and negativity
The Politburo also clearly stipulates prohibited acts in protecting those fighting against corruption, waste, and negativity, such as: using violence, exerting pressure, slander, isolating, insulting, or violating the rights and legitimate interests of those fighting against corruption, waste, and negativity and their relatives.
Illegally violating the house or residence, occupying or destroying property, insulting the dignity or honor or having acts that affect the health or personal safety of those fighting against corruption, waste, negativity and their relatives.
Revenge or hire, ask, or incite others to mentally intimidate or take revenge on those fighting against corruption, waste, negativity, and relatives.
The Politburo strictly prohibits improper implementation of regulations, discrimination, setting criteria, conditions, comments, and assessments that impose disadvantages in personnel work, rewards, and disciplines for those fighting against corruption, waste, and negativity and their relatives; rotating, mobilizing, and seconding those fighting against corruption, waste, and negativity while handling cases.
Causing difficulties or obstacles in implementing the regimes and policies of the Party and State, handling administrative procedures and public services according to the provisions of law, production, business, career, employment, labor, study or performing tasks of those fighting against corruption, waste, negativity and relatives.
It is strictly forbidden to block or destroy information, documents, and evidence on the fight against corruption, waste, and negativity; to conceal, fail to report, delay, or improperly process or verify requests for protection; and to disclose information that needs to be kept confidential during the protection process.
Failure to promptly direct and resolve difficulties and obstacles of organizations and individuals in performing protection tasks; failure to change members performing protection tasks when there is evidence to determine that such members are irresponsible and not objective in performing their tasks.
The Politburo also strictly prohibits taking advantage of the fight against corruption, waste, and negativity to slander other agencies, organizations, and individuals, and other prohibited acts according to Party regulations and State laws.
The regulation also clearly states that Party committees, Party organizations and leaders will be considered and disciplined according to Party regulations and State laws if they allow Party organizations, cadres and Party members of their agencies and organizations to violate regulations on protecting people fighting against corruption, waste and negativity.
Individuals who violate this regulation will be handled according to the nature and severity of the violation according to the regulations of the Party and the laws of the State.
Those who take advantage of the fight against corruption, waste, and negativity to distort the truth, slander, fabricate accusations, or cause internal disturbances will, depending on the nature, extent, and consequences, be subject to disciplinary action, administrative sanctions, or criminal prosecution.
