Recently, a clip recording a father and son driving a car on the road has gone viral on social media. Notably, the driver is not the father but the 12-year-old son.
The video, which is more than 2 minutes long, was recorded by the father himself on his phone and is said to have been livestreamed on his personal page.
"Today, dad drank alcohol and the youngest son drove dad home", "I am dad's son so I have to drive dad home every time dad is drunk", "I'm reporting to you guys that I'm only 12 years old and in 6th grade", the father continuously said in the video.
The clip was then quickly shared on social networking forums about cars and immediately received "a shower of criticism" from the community.
"Letting a 12-year-old child drive a car, this father is truly committing a serious crime by playing with human life, he needs to be severely punished as an example," commented reader Manh Thang.
"Seeing the card on the car, maybe this guy is a driving instructor and the car has auxiliary brakes so he was too confident to give the car to his son. But the more someone who teaches driving, the more they have to obey the law, so they should be severely punished and have their license revoked forever," reader Thanh Minh expressed his opinion.
"It's possible that the car was towed by a tow truck or a crane and this dad wanted to prank everyone online. But joking like that is also very reprehensible and should still be punished," reader Khac Tin has a different perspective.
If the act of handing over the car to his 12-year-old son in the clip is true, the father has seriously violated the provisions of the Law on Road Traffic Order and Safety and could be heavily fined according to Decree 168/2024/ND-CP.
Specifically, Article 9 of the Law on Road Traffic Order and Safety, effective from January 1, 2025, clearly states that the act of "Handing over motor vehicles and specialized motorbikes to people who do not meet the conditions prescribed by law to drive vehicles on roads" is in the group of 27 prohibited acts.
Article 56 of the 2024 Law on Road Traffic Order and Safety stipulates the conditions for drivers participating in road traffic, in which drivers participating in road traffic must be of age and in good health according to the provisions of law; have a valid driver's license with remaining points, suitable for the type of vehicle being driven, issued by a competent authority.
Regarding the penalty for the above case, at Point i, Clause 14, Article 32 of Decree 168/2024/ND-CP, a fine of VND 28-30 million shall be imposed on individuals and VND 56-60 million shall be imposed on organizations that are owners of automobiles, four-wheeled motorized passenger vehicles, four-wheeled motorized cargo vehicles, specialized motorbikes and similar vehicles that hand over the vehicle or allow a person who does not meet the conditions prescribed in Clause 1, Article 56 of the Law on Road Traffic Order and Safety 2024 to drive the vehicle in traffic.
