Many parents have paid to reserve their children's places in grade 10 at some private high schools in Hai Duong City. People wonder whether the schools are collecting this amount of money right or wrong?

Thanh Dong High School temporarily collects 3 million VND/student when candidates submit application for admission to grade 10 of the school.

A representative of An Phuoc Law Company Limited (Hanoi) said that based on the Civil Code, the Law on Fees and Charges, the Law on Education, Decree 04/2021/ND-CP regulating sanctions for administrative violations in the field of education, Decree 69/2008/ND-CP on policies to encourage socialization of activities in the fields of education, vocational training, health, culture, sports, environment and a number of circulars guiding the implementation... private high schools collecting reservation fees is not contrary to the provisions of law.

The laws do not contain any prohibition or penalty provisions (for this behavior), and do not contravene the provisions of the Education Law and management rules on revenue and expenditure for private and non-public schools (which have the right to autonomy in revenue and expenditure, and are responsible before the law).

According to the Hai Duong Department of Education and Training, this is a voluntary civil agreement between parents and schools. However, schools must publicly and transparently disclose the collection so that parents can understand.

It is known that among 15 non-public high schools in the province, Thanh Dong and Marie Curie High Schools (Hai Duong City) collect deposit money from students when submitting applications for admission to grade 10 of these two schools.

The amount that parents deposit for a place is 3 million VND/student. This amount will be deducted from the tuition fees of the students later. Thanh Dong High School will refund the above amount if the student has applied to the school but is admitted to a public high school but does not attend or is not approved for admission to the school.

Of the 3 million VND that Marie Curie High School temporarily collects, there is an admission fee of 1 million VND/student, which is non-refundable in all cases. The reservation fee of 2 million VND/student will not be refunded if the student does not attend the school and will be included in the school's Scholarship Fund.
