The National Assembly agreed not to pass the revised Land Law at the 6th session.

On the morning of November 22, with 453/459 delegates present in agreement, the National Assembly unanimously agreed to adjust the approval of the revised Land Law project from the 6th session to the nearest session.

Previously, Secretary General and Head of the National Assembly Office Bui Van Cuong, on behalf of the National Assembly Standing Committee, presented a report on adjusting the agenda of the 6th session. According to the current agenda, the National Assembly will vote to pass the draft Land Law (amended) on November 29.

However, the National Assembly Standing Committee believes that the draft Law still has some major contents and policies that need further study to design optimal policy options. Reviewing and perfecting the draft Law needs more time to ensure its constitutionality, legality and consistency with the legal system.

Therefore, adjusting the time for passing the Land Law (amended) project from this session to the nearest session helps agencies to continue to research, absorb, revise, thoroughly review and perfect the draft Law, ensuring the best quality before submitting it to the National Assembly for approval.

Currently, the draft law has 14 issues with two options for National Assembly comments.

Regarding the State's land acquisition for commercial housing projects, mixed housing, commercial and service projects, the Drafting Committee has designed two options: Stipulating that these projects are subject to State acquisition for land use rights auctions and investor selection bidding; or projects must be attached with specific criteria and conditions in cases where the State acquires land for socio-economic development for national and public interests.

Proposing option one, the Government said that auctioning land use rights helps increase budget revenue; bidding helps select capable investors, implementing projects with spillover effects. Meanwhile, some delegates said that a self-negotiation mechanism should be applied to ensure the rights of those whose land is recovered and reach consensus with investors.

There are two options for land valuation methods and the cases and conditions for application (Article 159). One is to stipulate in the law the content of the method and assign the Government to stipulate the cases and conditions for application. The other is to stipulate in the law the content, cases and conditions for application of each method to ensure publicity, transparency and feasibility. The Government proposes option one.

National Assembly Chairman Vuong Dinh Hue and many delegates are inclined towards option two because more specific regulations help "protect officials" and ensure feasibility for implementing agencies, avoiding legal troubles when applying land valuation methods with different results.

Thus, after adjusting the program, on the morning of November 29, the National Assembly voted to pass the Resolution on applying additional corporate income tax according to regulations against global tax base erosion; voted to pass the Resolution on the results of thematic supervision of "the implementation of the National Assembly's Resolutions on the National Target Programs on new rural construction for the 2021-2025 period, sustainable poverty reduction for the 2021-2025 period, and socio-economic development in ethnic minority and mountainous areas for the 2021-2030 period".

From 9:00 a.m., the National Assembly held its closing session and voted to pass the Resolution on questions and answers; voted to pass the Resolution of the 6th Session, 15th National Assembly.
