After more than 20 years of investment and construction, the Lai Cach commercial urban area project in Cam Giang district (Hai Duong) is still in disarray, like a "mess".

The investor designs and implements the construction himself.

The Lai Cach commercial urban area project was implemented in 2003, initially invested by the People's Committee of Cam Giang district. The district planned and invested in building roadbeds and drainage systems on an area of ​​8.3 hectares in Lai Cach town. However, due to some unfinished technical infrastructure items, the project was not eligible for auction of land use rights.

In 2008, to attract investment and develop Lai Cach town, Cam Giang District People's Committee planned to expand the above project into Lai Cach commercial urban area with an area of ​​over 50.2 hectares and was approved by the Provincial People's Committee for the 1/2000 scale planning in Decision No. 672/QD-UBND dated February 19, 2009. On January 12, 2011, Viet My Hai Duong One Member Co., Ltd. was selected as the investor through bidding.

Up to now, the area of ​​nearly 12.6 hectares of land handed over to the investor for use in implementing the project is all in phase 1, the remaining 37.6 hectares of phase 2 have not yet been cleared. The deadline according to the Prime Minister's decision to approve the recovery of rice fields has also expired, so there is no longer a basis for carrying out the site clearance work.

Since 2015, 2016, 2018, 2019 and 2021, the People's Committee of Hai Duong province has repeatedly issued decisions approving adjustments to the detailed construction planning of Lai Cach commercial urban area at a scale of 1/2000, then at a scale of 1/500; the total investment was from more than 525.8 billion VND, then the first adjustment with the total investment reduced to more than 513.4 billion VND...

Although the Provincial People's Committee had to make many adjustments, up to now, the investor of Lai Cach commercial urban area project, Viet My Hai Duong Company, has not yet established an adjusted project according to the adjusted planning approved by the Provincial People's Committee; has not yet established, appraised and approved the design drawings for the technical infrastructure items of the project according to regulations. The investor has established and implemented the construction documents themselves from 2013-2020.

The investor has not yet completed the procedures for approving the design and construction of works within the National Highway 5 corridor and the petroleum pipeline; has not completed internal traffic works; regional traffic connections; construction is not in accordance with the planning and design of some items of rainwater drainage, wastewater, electricity supply, and green trees; some problems with financial obligations...

During the project implementation, Viet My Hai Duong Company had many violations of land and construction order and was recorded and handled by competent authorities or verification and inspection teams when people complained.

Consequences of "putting the cart before the horse"

There are many violations, land sale in the project is not allowed, but in reality, many residential plots in phase 1 have been transferred by the investor through the form of "capital contribution contracts"... Many people have "put down money" to buy land.

Although no "red book" has been issued in Lai Cach commercial urban area, many people have illegally built houses and shops and used them for many years.

In the area where the project has been implemented, many residential buildings of the people do not meet the conditions for construction permits but have been invested in and put into use for many years. Some houses have arbitrarily built lots, encroached on technical roads...

The most pressing issue is that the 8,117 m2 planned market in Lai Cach commercial urban area has been closed for 10 years and cannot be completed, although 80% of the construction was completed by the end of 2014. Currently, there are about 500 households living in the temporary market on Doan Ket street and the alleys of area 18 surrounding the new market mentioned above.

According to the Department of Construction, by 2021, the detailed construction planning adjustment at a scale of 1/500 of the project had just been approved by the Provincial People's Committee, but the investor had already built the market in 2013 without completing the procedures for investment, land, environment, design, construction licensing... The consequences of "putting the cart before the horse" are overlapping boundaries; the functions and usage structures of some locations are not suitable... The design and construction of the market with stalls, narrow walkways and lack of essential technical infrastructure items, especially fire prevention and fighting, made traders not accept to enter the market. Not to mention, many standards and regulations on market construction planning at that time are no longer suitable, making it difficult to assess and continue construction.

Difficult to handle

Lai Cach Town People's Committee has issued many documents requesting the People's Committee and relevant functional departments of the district and province to have solutions to overcome limitations to soon put the above-mentioned people's market into operation, in order to eliminate the shortcomings caused by the current operation of the temporary market in the area.

“People who own land in Lai Cach commercial urban area really want to build houses and are ready to apply for permits but have not been granted red books. Therefore, members of the town's Land Violations Handling Team are taking turns to monitor, detect and promptly prevent illegal construction activities,” said Mr. Nguyen Van Minh, Chairman of Lai Cach Town People's Committee.

The Provincial People's Committee has directed, Cam Giang District People's Committee has reviewed the investment implementation process, the current status of project implementation and proposed recommendations to remove obstacles. The Department of Construction is assigned to preside, together with related sectors, to review the current status of the above project to advise on handling.

According to the representative of the Department of Construction, the investor implemented the construction of the project's technical infrastructure on the assigned land when the documents had not been appraised in accordance with regulations. Therefore, there were some discrepancies between the current construction status and the appraised basic design documents. On the other hand, because there were no documents on project quality management for the 2013-2015 period, there were many difficulties in inspecting and accepting the project.

The Department of Construction has repeatedly instructed and urged the investor and the People's Committee of Cam Giang district to review the construction investment work, overcome the project's limitations, and make specific proposals and recommendations. However, according to the representative of the Department of Construction, despite being invited to work many times by the department, the investor did not come.

It is known that Viet My Hai Duong Company is facing many financial difficulties, so there is still no answer to completely resolve the difficulties to open the project.
