On February 13, continuing the program of the 9th Extraordinary Session, the National Assembly Delegation of Hai Duong province discussed in groups the Draft Law on Government Organization (amended), the Law on Organization of Local Government (amended) and the draft Resolution of the National Assembly regulating the handling of a number of issues related to the arrangement of the State apparatus.

Speaking on the draft Law on Organization of Local Government (amended), Lieutenant General Nguyen Hai Hung, Deputy Chairman of the National Assembly's Committee on National Defense and Security, proposed to stipulate that the Commander of the District Military Command is a member of the District People's Committee.

"The police force has a very clear policy of abolishing district-level police. As far as I know, the Ministry of National Defense has not yet given any direction on district-level military agencies. Therefore, if the law does not clearly stipulate that the People's Committee member in charge of military affairs at the district level will not have a member in charge of military affairs at the district level," said Lieutenant General Nguyen Hai Hung.

Based on his experience working at the local level and being in charge of military work at the district and provincial levels, Lieutenant General Nguyen Hai Hung realized that at any level of local government, there must be a military agency as a staff agency at that level.

"As you know, the local military agency is not an agency directly under the provincial People's Committee. However, its main task is to advise on local defense work. Military work is the responsibility of the vertical sector, while local defense work is under the direct leadership and direction of the Party Committee, the People's Committee and a number of other tasks that cannot be separated from the locality. If there is a district-level People's Committee, there must be a district-level military agency," Lieutenant General Nguyen Hai Hung commented.

Agreeing with delegate Hung's opinion, delegate Trieu The Hung, Vice Chairman of the National Assembly's Committee on Culture and Education, suggested that the drafting agency carefully consider this regulation.

With experience as the head of the People's Committee of Hai Duong province, delegate Trieu The Hung assessed that the draft law clearly stipulates decentralization and delegation of power, creating favorable conditions for local authorities in performing their tasks.

Regarding the content related to district-level military agencies, delegate Trieu The Hung suggested that the law should be considered and evaluated fundamentally when drafting the law. In addition to the task of protecting the Fatherland, local military forces also perform many important tasks with local authorities such as overcoming the consequences when natural disasters occur. The drafting of provisions in the law needs to be considered fundamentally, with assessments based on current practices in management and operation.

Contributing comments to the draft Law on Organization of Local Government (amended), delegate Nguyen Ngoc Son, Standing Member of the National Assembly's Committee on Science, Technology and Environment, suggested continuing to review and clarify the three concepts of decentralization, delegation of authority, and authorization to institutionalize them into specific regulations.

The drafting agency needs to continue reviewing and supplementing concepts, especially clarifying the connotation of decentralization, delegation of authority and responsibility, the right to be decentralized, to be delegated, to be authorized. Only when these concepts are clarified can related contents such as rewards, handling of administrative violations, and even handling of criminal violations be handled.

Delegate Bui Sy Hoan, Director of the Department of Justice of Hai Duong province, requested clarification of the applicable principles due to conflicts between the draft Law on Organization of Local Government and the Law on Promulgation of Legal Documents.

According to delegate Bui Sy Hoan, these two laws are expected to be issued in the same session but there is a conflict. Therefore, it is necessary to clarify the principles of application between the two laws.

At the same time, the Director of the Department of Justice of Hai Duong province suggested that it is necessary to review the regulations fully to unify and avoid conflicts as in the current drafts.
