The difference in land compensation prices under the 2024 Land Law and the 2023 law has led to problems in more than 1,000 projects in Hanoi.
At the conference to summarize 2024 and deploy tasks for 2025, on the morning of December 21, the Hanoi Department of Natural Resources and Environment said that there are currently more than 1,000 unfinished projects in the area that have implemented land acquisition, approved compensation plans, support, and partial resettlement according to the 2013 Land Law, the remaining area will be implemented according to the 2024 Land Law.
According to the management agency, this reality has led to some problems such as inconsistent land clearance policies in the same project, and people who are compensated, supported, and resettled under the 2024 Land Law are basically more beneficial.
Along with that, many projects have announced land recovery for more than 12 months according to the provisions of the 2024 Land Law, which are not subject to transition, and have also encountered problems.
Many projects have been carried out by the People's Committees of districts, towns and cities, such as investigating and counting assets on land; confirming the origin of land use; making compensation, support and resettlement plans; and organizing public posting of plans according to the provisions of the 2013 Land Law, but have not yet decided to recover land and approved compensation, support and resettlement plans.
"If implemented according to the provisions of the 2024 Land Law, many difficulties will arise in terms of time, progress, and costs," said the Hanoi Department of Natural Resources and Environment.
To resolve the issue, Hanoi City requested the Ministry of Natural Resources and Environment to consult with the Government and central agencies to allow the city to use the documents that have been implemented such as the results of measurement, inventory, and verification of land origin to implement the next steps with projects that have fully implemented the compensation, support, and resettlement procedures according to the 2013 Land Law.
For cases of compensation, support and resettlement according to the 2024 Land Law and its implementing guidelines, where the basic policies remain unchanged and the households have agreed, immediately implement the steps according to the land recovery decision and the decision approving the compensation, support and resettlement plan.
In cases where, after review, the benefits of the person whose land is recovered arise in favor of the person whose land is recovered according to the 2024 Land Law, adjustments will be made to the compensation, support, and resettlement plan and approved according to regulations.
In case the policy under the 2013 Land Law and other specific policies approved by the City People's Committee are more favorable to people whose land is recovered, the more favorable approved policy shall be applied.
Hanoi's adjusted land price list is effective from December 20 to the end of 2025. Of which, the highest residential land price is over 695.3 million VND per square meter for plots facing the streets of Hoan Kiem district. This price is nearly 3.7 times higher than the old price list.
Meanwhile, land on the streets of the three districts of Cau Giay, Thanh Xuan, and Tay Ho increased by an average of 225%. Similarly, this location in the five districts of Long Bien, Hoang Mai, Ha Dong, Bac Tu Liem, and Nam Tu Liem was also adjusted higher by an average of 210%. According to the Hanoi Department of Natural Resources and Environment, in general, residential land prices according to the new table increased by an average of 150-270%.
These adjustments were made by the Department of Natural Resources and Environment based on an investigation and survey of actual transfer prices over the past two years. The agency collected more than 20,740 survey forms in 30 districts and 579 communes, wards and towns.
