The Korean Ministry of Justice has just issued a document announcing the policy of extending the period of stay according to the passport validity period divided into 2 phases.
This is the legal basis for protection.sureThe period of stay is extended in accordance with the passport validity period to avoid inconvenience to foreigners working and living in Korea.
Accordingly, from July 1, 2021 to June 30, 2022, foreign citizens with passports valid for less than 1 year will be considered valid for 1 year and will be granted a 1-year extension of stay. For example: Case 1, passport validity remaining 5 months (less than 1 year) will be granted a 1-year extension of stay, even if all conditions for a 2-year or more extension are met. Case 2, passport validity remaining 1 year and 2 months (over 1 year) will be granted a 1-year and 2-month extension (equal to the passport validity), even if all conditions for a 2-year or more extension of stay are met.
Vietnamese workers still go to South Korea to work despite the complicated Covid-19 epidemic in both countries.
From July 1, 2022 onwards, which is exactly 1 year of applying the above policy, in case a foreign citizen still has a valid residence period but cannot reissue a passport due to loss of passport or other reasons, if the passport validity is less than 6 months, it will be considered valid for 6 months and the stay will be extended for 6 months. Case 1, the passport validity is 5 months (less than 6 months) will be extended for 6 months, even in cases where the person fully meets the conditions for an extension of stay of 2 years or more. Case 2, the passport validity is 8 months (over 6 months) will be extended for 8 months (equal to the passport validity), even in cases where the person fully meets the conditions for an extension of stay of 2 years or more.
This provision does not apply to foreigners holding diplomatic (A-1), official (A-2), international agreement (A-3), permanent resident (F-5) passports; foreigners determined to be refugees (F-2), family members (F-1), people applying for humanitarian/refugee status (G-1); and stateless persons.
Thus, Vietnamese workers going to work in Korea under current cooperation programs will be subject to the above regulations.
