In which cases will pension be suspended or stopped from July 1?

Pursuant to Article 75 of the Law on Social Insurance 2024 (effective from July 1, 2025),suspend pension and social insurance benefitsmonthly for beneficiaries in one of the following cases:

The first,Illegal exit. Note: Continued payment including pension, monthly social insurance benefits for the period not yet received when the illegal exit person returns.

Monday,declared missing by the court. Note: Continued payment including pension, monthly social insurance benefits for the period not yet received if there is a court decision to cancel the decision declaring missing.

Tuesday,When the beneficiary's information cannot be verified (annually, the beneficiary of social insurance benefits through a personal account opened at a bank is responsible for coordinating with the social insurance agency or a service organization authorized by the social insurance agency to verify information that qualifies for social insurance benefits). Compared to the Law on Social Insurance 2014, this is a new provision of the Law on Social Insurance 2024.

Note: Continued payment will include pension and monthly social insurance benefits for the period not yet received if the information has been verified.

Termination of pension and social insurance benefitsmonthly for beneficiaries in one of the following cases:

The first, died or was declared dead by the court. Note: continued payment including pension, monthly social insurance benefits for the period not yet received if there is a court decision to cancel the decision declaring death.

Monday,Refusing to receive monthly pension and social insurance benefits in writing. Note: The monthly pension and social insurance benefits of this subject will continue to be paid from the time the social insurance agency receives the written request to receive the monthly pension and social insurance benefits again, and does not include the monthly pension and social insurance benefits for the period not yet received due to refusal to receive.

Tuesday,The conclusion of the competent authority on social insurance benefits is not in accordance with the provisions of law (according to the Law on Social Insurance 2014, this case is only temporarily suspended).

In addition, Article 75 of the Law on Social Insurance 2024 also has the following provisions:Important content:

If a pensioner or monthly social insurance beneficiary has not received the pension or benefit for a period of time before his/her death, his/her relatives will receive the pension or benefit for the months not yet received.

A person whose monthly pension or social insurance benefits are suspended when there is a court decision declaring him/her missing, and then there is a court decision declaring him/her dead, his/her relatives will not be entitled to receive pension or benefits during the suspension period.
