Delegates suggested further assessment of the current implementation of commercial housing projects to have appropriate and effective pilot policies, thereby removing difficulties and preventing land collection and speculation.
On the morning of November 3, the National Assembly Standing Committee gave opinions on the draft Resolution on piloting the implementation of commercial housing projects through agreements on receiving land use rights or having land use rights.
According to the Government's submission, the resolution is intended to continue to concretize the Party's policies and guidelines on "Continuing to implement the mechanism of self-negotiation between people and enterprises in transferring land use rights to implement urban and commercial housing projects."
At the same time, create a legal corridor to manage the land use rights market and the real estate market to develop stably, healthily, openly and transparently; create favorable conditions for land users and investors to be proactive in implementing commercial housing projects and urban development projects, minimize the intervention of administrative agencies, limit the State's land acquisition which can easily lead to complaints from the people...
Examining this content, Chairman of the National Assembly's Economic Committee Vu Hong Thanh stated that the Standing Committee of the Economic Committee agreed with the necessity of developing a resolution; requested the Government to conduct a detailed and comprehensive assessment of the practical development of commercial housing, the effectiveness of using land funds for commercial housing development in provinces and centrally run cities; assess the current situation of land acquisition and speculation; and solutions to limit the negative impacts of the pilot.
Regarding the name of the resolution, the Chairman of the Economic Committee said there are 3 types of opinions.
The first type of opinion is that this Resolution only regulates the pilot implementation of commercial housing projects through agreements on receiving land use rights or having land use rights that are not residential land; therefore, the name of the resolution should be "Resolution on pilot implementation of commercial housing projects through agreements on receiving land use rights or having land use rights that are not residential land."
The second type of opinion agrees with the name proposed by the Government in the Submission.
The third type of opinion is that this resolution is only piloted for two contents: land type and procedures for agreement to receive land use rights transfer, so the proposed resolution name is "Pilot resolution on agreement to receive land use rights or having land use rights to implement commercial housing projects."
Many opinions of the Standing Committee of the Economic Committee agree with the first type of opinion.
Regarding the criteria for selecting pilot projects (Article 3), the Standing Committee of the Economic Committee proposed to clarify the basis for setting the criterion of not exceeding 30% of the additional residential land area during the planning period; the implementation principles for cases where there are many proposed pilot projects, especially in some localities where many projects are stuck (Hanoi, Ho Chi Minh City).
At the same time, the appraisal agency proposed to study and stipulate specific criteria for selecting pilot projects, noting the order of priority for pilot selection and project criteria.
Members of the National Assembly Standing Committee basically agreed on the necessity of developing a draft pilot resolution to submit to the National Assembly for consideration and approval at the 8th Session to institutionalize the Party's policy, contributing to unlocking land resources, creating conditions for socio-economic development, and meeting people's housing needs.
