Question: My brother paid social insurance for 11 months. Then he died in an accident. Can his relatives withdraw his insurance? How much is the benefit?
Regarding this issue, Vietnam Social Security informs as follows:
Article 69 of the 2014 Law on Social Insurance stipulates that in cases where an employee dies, relatives are entitled to a one-time death benefit as follows:
1. The deceased worker does not fall into the following cases:
a) Having paid social insurance for 15 years or more but not yet received a one-time social insurance benefit;
b) Receiving pension;
c) Death due to work accident or occupational disease;
d) Currently receiving monthly occupational accident and disease benefits with a working capacity reduction of 61% or more.
2. The deceased employee falls into one of the cases specified in Point 1 above but has no relatives to receive monthly pension.
3. Relatives who are eligible for monthly survivor benefits and wish to receive a one-time survivor benefit, except for children under 6 years old, children or spouses whose working capacity is reduced by 81% or more.
In your brother's case, if he participated in compulsory social insurance for 11 months and died due to an accident, but not a work accident, his relatives will receive a one-time death benefit.
The benefit level as prescribed in Clause 1, Article 70 of the 2014 Law on Social Insurance is 3 months of the average monthly salary for social insurance contribution.
The average monthly salary for social insurance payment as the basis for calculating one-time death benefits is implemented according to the provisions of Article 62 of the Law on Social Insurance.
