The Ministry of Labor, War Invalids and Social Affairs has just submitted a document to the Prime Minister for consideration of a plan to swap working days to connect the 5-day holiday period of April 30 - May 1.
In the submission signed on the morning of April 11, according to the Ministry of Labor, Invalids and Social Affairs, the swap plan was proposed after collecting opinions and synthesizing from 15 relevant ministries and agencies. To date, 13 ministries and agencies have participated in the proposal, 100% agreeing with the plan proposed by the Ministry of Labor, Invalids and Social Affairs.
Specifically, most ministries and agencies believe that arranging to swap normal working days and make up for them on other days will help ensure that people across the country have a harmonious and complete holiday, while also stimulating tourism, social consumption, and promoting economic growth.
At the same time, this swap does not change the working time fund of cadres, civil servants, public employees and workers. The results of the survey of workers by the Vietnam General Confederation of Labor also show that the majority of workers support the proposal of 5 days off.
Regarding the legal basis, the representative of the Ministry of Labor, Invalids and Social Affairs said that according to the provisions of Clause 3, Article 112 of the Labor Code, every year, based on actual conditions, the Prime Minister decides specifically on the Lunar New Year and National Day holidays.
Point b, Clause 2, Article 28 of the Law on Organization of the Government 2015 (amended and supplemented in 2019) also stipulates the duties and powers of the Prime Minister: "Directing the management of cadres, civil servants and public employees in state administrative agencies and public service units".
On that basis, the Ministry of Labor, Invalids and Social Affairs reported to the Prime Minister a plan to swap the normal working day on Monday, April 29, during the April 30 - May 1 holiday this year and organize another compensatory working day.
Specifically, for civil servants and public employees, this working day will be swapped to Saturday, May 4. With this swap, civil servants and public employees will have 5 consecutive days off from Saturday, April 27 to Wednesday, May 1.
For employees, the Ministry of Labor, Invalids and Social Affairs encourages employers to apply the April 30 - May 1 holiday as prescribed for civil servants and public employees. The state labor management agency requires ensuring full implementation of the regimes for employees according to the law, encouraging agreements that are more beneficial to employees.
Based on these analyses, the Ministry of Labor, Invalids and Social Affairs proposes that the Prime Minister consider and decide on the holidays of Victory Day April 30 and International Labor Day May 1 in 2024 and assign the Minister of Labor, Invalids and Social Affairs to notify state administrative agencies, public service units, enterprises and employees to know and implement.
The April 30 - May 1 holiday will be the longest holiday in 2024, just after the 7-day Tet holiday. In addition, workers will have another holiday in April, which is the Hung King's Commemoration Day (10/3 Lunar calendar, Thursday, April 18, 2024). After the concentrated holidays in April 2024, people across the country will have another holiday, which is the National Day on September 2.
