The National Assembly Standing Committee proposed that the Government promptly complete the Projects on rearranging administrative units at district and commune levels for the 2023-2025 period and submit them to the Committee for consideration and decision in 2024.
Secretary General of the National Assembly Bui Van Cuong has just announced the Conclusion of the National Assembly Standing Committee on the arrangement of administrative units at district and commune levels for the period 2023-2025 (at the 33rd Session, May 2024).
The National Assembly Standing Committee highly appreciated the proactiveness, positivity and responsibility of the Government, the Prime Minister, the Ministry of Home Affairs, ministries, central and local agencies in the process of implementing the arrangement of district and commune-level administrative units for the 2023-2025 period according to the Party's policy and the requirements in Resolution No. 35/2023/UBTVQH15 of the National Assembly Standing Committee on the arrangement of district and commune-level administrative units for the 2023-2030 period.
The National Assembly Standing Committee requested the Government to continue directing ministries and branches to urgently synthesize and review difficulties and problems of localities in the process of developing the Project on rearranging administrative units at district and commune levels for the 2023-2025 period; promptly guide and resolve within their authority to simplify administrative procedures, reduce the time for implementing processes and procedures related to the rearrangement of administrative units to soon complete the Project on rearranging administrative units at district and commune levels for the 2023-2025 period and submit it to the National Assembly Standing Committee for consideration and decision in 2024.
For contents that need adjustment and guidance different from the resolutions of the National Assembly Standing Committee on urban classification, standards of administrative units and classification of administrative units, the Government is requested to promptly complete the dossier, submit it to the National Assembly Standing Committee for consideration and issue a resolution according to the shortened procedures.
When developing the Project on rearranging administrative units at district and commune levels for the 2023-2025 period, the National Assembly Standing Committee proposed to pay attention to a number of contents.
In case a commune is subject to compulsory rearrangement and that commune has been determined to be located in the inner city or inner town area of a city or town according to the urban classification decision of the competent authority and cannot be arranged with any other rural administrative unit, but can only be merged into a ward, it is not necessary to evaluate and review the urban classification criteria for the city or town and it is not necessary to review the level of infrastructure development for the ward formed after the rearrangement.
In case of adjusting part of the natural area of a ward with a ward, or a district with a district, it is not necessary to conduct an assessment of the standards on the structure and level of socio-economic development and the standards on the level of urban infrastructure development of the district or ward formed after the arrangement according to the provisions of Resolution No. 1210/2016/UBTVQH13 dated May 25, 2016 of the Standing Committee of the National Assembly on urban classification, which has been amended and supplemented by a number of articles according to Resolution No. 26/2022/UBTVQH15 dated September 21, 2022 of the Standing Committee of the National Assembly (called the Resolution on urban classification) and Resolution No. 1211/2016/UBTVQH13 dated May 25, 2016 of the Standing Committee of the National Assembly on standards of administrative units and classification of administrative units, which has been amended and supplemented by a number of articles according to Resolution No. 27/2022/UBTVQH15 dated September 21, 2022 of the Standing Committee of the National Assembly (called Resolution on standards of administrative units and classification of administrative units).
In case of arranging, establishing, merging, dividing, or adjusting the boundaries of district-level urban administrative units while the wards under their management remain the same, it is not necessary to re-evaluate the standards on the structure and level of socio-economic development and the standards on the level of urban infrastructure development of the ward according to the provisions of the Resolution on urban classification and the Resolution on standards of administrative units and classification of administrative units.
In case of adjusting the administrative boundary between Hai An district (part of Dong Hai 1 ward) and Thuy Nguyen district of Hai Phong city to overcome the unreasonable administrative boundary line, it is necessary to classify urban areas and evaluate the standards of urban infrastructure development level for the area planned to establish Thuy Nguyen city and the area planned to establish wards of Thuy Nguyen city; it is not necessary to evaluate the standards of urban infrastructure development level for Dong Hai 1 ward and Hai An district of Hai Phong city.
Data on natural area, population size and other data used to develop the Administrative Unit Arrangement Project are calculated as of December 31, 2022.
In case the locality finds it more beneficial, the data in the Project dossier shall be updated by December 31 of the previous year adjacent to the year in which the Project dossier is submitted to the Ministry of Home Affairs (noting that the time to finalize data on natural area and population size as the basis for determining district-level and commune-level administrative units subject to the 2023-2025 arrangement period is December 31, 2022).
Regarding funding to support the implementation of administrative unit rearrangement at district and commune levels, the Resolution clearly states: Based on the implementation results of localities, the Government will synthesize and prepare a budget for additional targeted support for localities to implement administrative unit rearrangement from the central budget in the 2025 state budget estimate, supplement the 2024 state budget estimate, propose to identify sources and implementation mechanisms to report to the National Assembly for consideration and decision at the 8th session (October 2024).
