5 tightening, 5 opening in inspection service business
At the conference, Mr. Nguyen Van Phuong, Deputy Head of the Department of Motor Vehicle Inspection, Vietnam Register, said that almost all regulations in Decree 139/2018/ND-CP were amended in Decree 30/2024/ND-CP. However, regarding the current business activities of motor vehicle inspection services, there are 5 "tightening" regulations and 5 "opening" regulations to help manage more closely and create more favorable conditions for units participating in this activity.
In which, 5 tightening regulations include: Stricter management of licensing for inspection units when requiring additional documents approving investment policies of competent local authorities; clear and transparent decentralization of state management responsibilities at central and local levels in licensing and managing the activities of inspection units and inspectors; stricter and clearer regulations on the organizational structure and human resources of inspection units, clarifying the responsibilities of unit leaders, heads of inspection departments, inspectors, and professional staff; increasing sanctions for violations of inspection units and inspectors to increase deterrence and increase the responsibility of inspection units, binding the responsibility of the organization establishing the inspection unit if violations occur.
There are 5 open regulations including: automobile warranty and maintenance facilities, transportation units, and inspection units of the police and army can participate in providing inspection services (when permitted by the Minister of Public Security and the Minister of National Defense); the police and army forces can participate in supporting the inspection of civil motor vehicles in urgent cases; adjust the minimum number of personnel in the chain to reduce the risk of stopping operations while encouraging inspection units to improve the quality of human resources; reduce the internship time for those who have experience working directly at automobile warranty and maintenance facilities and abolish the regulation on controlling the number of inspected vehicles per day of the inspection unit to maximize the initiative and flexibility of the inspection units.
Conditions for warranty and maintenance facilities to participate in vehicle inspection
To participate in the business of motor vehicle inspection services, warranty and maintenance facilities must also commit to working 5 days/week, at least 8 hours/day. At the same time, they must comply with the conditions on facilities and conditions on organizational structure and general human resources of a regular inspection center.
Specifically, in terms of facilities, the inspection unit's premises are used to arrange facilities serving the inspection of motor vehicles on the same land plot, with a minimum area used for inspection activities of 1,250 m2 for inspection units with one type I inspection line; 1,500 m2 for inspection units with one type II inspection line and 2,500 m2 for inspection units with two inspection lines.
For inspection units with 3 or more inspection lines, the area used for inspection activities from the 3rd line onwards must increase accordingly for each line by no less than 625 m2.
At the same time, it must meet the regulations on inspection workshops with minimum clear dimensions (length x width x height) of 30 x 4 x 3.5 (m) for workshops with only one type I inspection line; dimensions of 36 x 5 x 4.5 (m) for workshops with only one type II inspection line.
For inspection workshops with many inspection lines arranged next to each other, the distance between the centers of the inspection lines must not be less than 4m and the distance from the center of the outermost line to the inner wall of the nearest inspection workshop must not be less than 2.5m.
In case the inspection line is arranged in many inspection workshops, the total minimum length of the inspection workshops must be equal to the length corresponding to the type of line specified in Point a and Point b of this Clause.
Regarding the regulations on inspection lines, inspection equipment and testing tools must be arranged and installed in accordance with national technical regulations issued by the Ministry of Transport, ensuring full inspection of systems, assemblies and details of motor vehicles participating in traffic to ensure technical safety and environmental protection according to the provisions of the Law on Road Traffic.
Regarding organizational structure, the inspection unit must have at least the following departments: Management Board; office department; inspection department.
Regarding the human resources of the inspection unit, it includes the unit leader, the person in charge of the inspection line, the senior motor vehicle inspector, the inspector and the professional staff. Of which, there must be at least 1 unit leader qualified to sign the inspection certificate; at least 1 senior motor vehicle inspector in charge of the inspection line; each inspection line must have at least 2 inspectors to ensure that all inspection stages are performed; and there are professional staff.
Mr. Nguyen Van Phuong, Deputy Head of the Department of Motor Vehicle Inspection, Vietnam Register, said that with the new regulations on inspection personnel, a senior inspector can be in charge of many inspection lines and an inspection center may only need 1 senior inspector to operate.
