On the afternoon of April 24, representatives of the Ho Chi Minh City People's Procuracy indicted Mr. Tran Qui Thanh and his two daughters. Accordingly, Mr. Thanh was recommended to be sentenced to 9-10 years in prison, Ms. Uyen Phuong was recommended to be sentenced to 5-6 years in prison, and Ms. Ngoc Bich was recommended to be sentenced to 4-5 years in prison.
According to the Procuracy, based on the defendants' statements, there is a basis to determine that from 2019 to 2020, Mr. Tran Qui Thanh, Ms. Tran Ngoc Bich, and Ms. Tran Uyen Phuong, through brokers, lent money to Mr./Ms. Lam Son Hoang, Nguyen Huy Dong, Nguyen Van Chung, and Dang Thi Kim Oanh.
This loan is at an interest rate of 3%/month, but requires the property/project owners to sign a contract to transfer the property/shares of the project to conceal the nature of the loan.
When the borrower fully performed the obligation to repay the principal and interest as agreed and committed to resell, Mr. Thanh and his son made up excuses not to return the property to the owner. The total value of the property that the defendants appropriated from the 4 victims was 1,048 billion VND.
Specifically, in the first case, through broker Nguyen Hoang Phu, the defendants lent Mr. Lam Son Hoang 115 billion VND by signing a fake notarized transfer contract, transferring the name from Mr. Lam Son Hoang, Mr. Nguyen Huu Nghia and his wife (Mr. Hoang's nephew) to Ms. Tran Uyen Phuong 4 plots of land in Hiep Binh Chanh commune, Thu Duc city with an interest rate of 3%/month; late payment penalty of 4.5%, disguised by commitments to resell.
When Mr. Lam Son Hoang had enough money to pay, Mr. Tran Qui Thanh's side used the excuse that Mr. Lam Son Hoang was late in paying and did not allow him to redeem the property. The value of the stolen property was more than 80 billion VND.
In the second case, through broker Doan Nguyen Minh Hoang, the defendants lent Mr. Nguyen Huy Dong 80 billion VND by signing a fake notarized transfer contract from Mr. Nguyen Huy Dong to Ms. Tran Uyen Phuong of 2 plots of land at 643 and 643A Kinh Duong Vuong, An Lac Ward, Binh Tan District, Ho Chi Minh City. This loan amount also had to pay an interest rate of 3%/month, a late payment penalty of 4.5%, disguised by commitments to resell.
When Mr. Nguyen Huy Dong had prepared enough 80 billion VND to receive back the 2 plots of land, the defendants demanded an additional 15 billion VND, not allowing him to redeem the property. The value of the appropriation was more than 38 billion VND.
In the third case, through broker Nguyen Phi Long, defendants Tran Qui Thanh and Tran Uyen Phuong lent Mr. Nguyen Van Chung 35 billion VND by signing a fake notarized transfer contract from Mr. and Mrs. Lam Hoang to Tran Uyen Phuong of 29 plots of land separated from plot 452 in An Lac ward, Binh Tan district, Ho Chi Minh City.
Mr. Nguyen Van Chung had previously bought the above land plot from Mr. and Mrs. Lam Hoang, without completing the name change procedure, with an interest rate of 3%/month.
When Mr. Nguyen Van Chung had prepared enough 35 billion VND to receive back 29 plots of land, the defendants demanded an additional 14 billion VND, not allowing him to redeem the property. The value of the appropriation was more than 48 billion VND.
In the fourth case, through broker Nguyen Hoang Phu, the defendants lent Ms. Dang Thi Kim Oanh (chairwoman of the board of directors of Kim Oanh Company) 500 billion VND by signing a fake contract to transfer shares of Minh Thanh Company, an agreement to promise to transfer/promise to receive the transfer of Nhon Thanh project to Ms. Tran Uyen Phuong, Tran Ngoc Bich, and TCS Company (a company under Tan Hiep Phat Group) with an interest rate of 3%/month, a late payment penalty of 4.5%/month, covered up by commitments to resell.
When Ms. Dang Thi Kim Oanh's side prepared enough money of 500 billion VND, Mr. Tran Qui Thanh's side made excuses for violating the terms of the contract, so they lost the right to buy back and were not allowed to redeem the property.
The value of the Minh Thanh project appropriation is more than 427 billion VND, the value of the Nhon Thanh project appropriation is more than 453 billion VND.
In this case, defendant Tran Qui Thanh is the one who must bear the main responsibility, followed by defendants Tran Uyen Phuong and Tran Ngoc Bich.
As for Mr. and Mrs. Nguyen Hoang Phu, Doan Nguyen Minh Hoang, Nguyen Phi Long, they are the "brokers" for the victims to borrow money from Mr. Tran Qui Thanh as mentioned above and received brokerage fees according to the agreement based on the loan amount (Nguyen Phi Long received 700 million VND from the loan of Nguyen Van Chung; Doan Nguyen Minh Hoang received 2.5 billion VND, Nguyen Hoang Phu received 23.65 billion VND from the loan of Ms. Dang Thi Kim Oanh and Mr. Lam Son Hoang).
However, after the brokerage, Nguyen Hoang Phu, Doan Nguyen Minh Hoang, and Nguyen Phi Long did not know the purpose of Mr. Tran Qui Thanh and his accomplices giving reasons to appropriate the property.
These people also did not help Mr. Tran Qui Thanh and his accomplices to appropriate property, so there is no basis for criminal prosecution against Phu, Hoang, and Long.
From there, the Procuracy proposed that the trial panel sentence Mr. Tran Qui Thanh to 9-10 years in prison; Tran Uyen Phuong to 5-6 years in prison; and Tran Ngoc Bich to 4-5 years in prison for the crime of abuse of trust to appropriate property.
Regarding the civil part, the Procuracy requested the trial panel to declare according to the law.
