To date, Hanoi City Police have identified 2,661 victims nationwide and seized assets estimated at VND5,200 billion related to the TikToker Mr Pips fraud case.

Hanoi City Police said they have prosecuted 31 people, including 26 defendants for fraud and appropriation of property, 3 defendants for money laundering, 1 defendant for failure to report a crime, and 1 defendant for harboring property from another person's crime related to the TikToker Mr Pips fraud case.

Before being prosecuted, Pho Duc Nam was known as a famous TikToker on social networks with livestreams providing analysis, comments, and forecasts on gold prices, cryptocurrencies... and often showing off his wealth.

Doctor, lawyer Dang Van Cuong said that the investigation agency will expand the investigation to clarify this property fraud ring.

In addition to the mastermind who created the scenario to commit the act of fraud and property appropriation and was criminally prosecuted, other subjects in this ring who knew that these were deceitful methods and tricks to appropriate property but still committed the act, with the same will as the leader, were also determined to be accomplices.

Those who know this is a fraud ring but do not report it will be criminally prosecuted for failure to report a crime under Article 390 of the Penal Code, with a possible penalty of up to 3 years in prison.

In addition, those who know clearly the amount of money and assets obtained from crime, but still accept them to put into transactions, in order to conceal the origin of the criminal assets, will be criminally prosecuted for money laundering according to the provisions of Article 324 of the Penal Code, with the highest penalty of up to 15 years in prison.

According to lawyers, the nature of money laundering is to turn dirty money into “clean” money - legally clean to conceal its origin. Along with the development of society, civil and economic transactions can easily take place and assets in society can be continuously transformed, so the act of “money laundering” is quite common.

Money laundering not only makes it difficult for authorities to detect and handle crimes, but also promotes crime, creating trust for criminals and strengthening their will to commit crimes.

Therefore, money laundering is similar to the act of consuming assets obtained by others through crime, but the purpose here is to conceal the crime and conceal the origin of the assets obtained through crime.

According to lawyers, the rapid development of science and technology makes activities in cyberspace always bustling, including financial investment, stock investment, virtual currency... The amount of money poured into investment activities in cyberspace is increasing and continuous.

However, not everyone who participates in investing in cyberspace has the capacity and understanding to manage risks. And the characteristics of communication in cyberspace are virtual and indirect, so it is very easy to be anonymous, to provide fake, fabricated, untrue information, and to commit fraud.

Lawyers advise investors who have lost money from these subjects' investment activities to urgently contact the investigation agency to provide information and documents on the subjects' criminal methods and other relevant documentary evidence so that the prosecution agency can include them in the list of victims.

“This case is a lesson for many young people who want to get rich quickly through cyberspace. This is also a lesson for many victims who lack investment knowledge, lack legal understanding, and want to make money quickly and easily in cyberspace,” said Dr. Dang Van Cuong.
