Prosecution of a group of subjects at Bach Giai Clinic for producing fake drugs

Checking Bach Giai Clinic on Giai Phong Street (Hoang Mai District, Hanoi), authorities discovered a large amount of counterfeit drugs bearing the trademark of a Vietnamese pharmaceutical company.

On January 5, Hanoi City Police announced that they had initiated a case and prosecuted Vu Thi Thao (born in 1996, in Lao Cai) and Lin Kai Yuan (born in 1985, Chinese nationality) for the crime of "Organizing others to stay in Vietnam illegally"; Duong Thi Nhu Hong (born in 2000, in Ninh Binh province) for the crime of "Producing counterfeit medicines and disease prevention medicines".

Previously, the Political Security Department (Hanoi City Police) discovered that "Bach Giai General Clinic" belonging to Hai Cat Medical Equipment Company Limited, located at 813-815 Giai Phong Street, had signs of violations in medical examination and treatment activities, complicated activities related to foreigners with Chinese nationality, so it requested the Hanoi Department of Health Inspectorate to coordinate in conducting a surprise inspection of the clinic.

At the time of inspection, the authorities discovered that the first to third floors of the clinic were licensed to operate but had no doctors and could not provide legal documents and records as required by law related to the clinic's operations.

The 5th floor is not licensed to operate but still has medical examination, treatment, and infusion services for patients.

On the 8th floor of the building, there are 4 people of Chinese nationality: Lin Kai Yuan, Zhang Wei (born in 1986), Xu Hong Chuang (born in 1990), Lin Yong Peng (born in 1987).

Of these, Xu Hong Chuang did not have a work permit, the remaining 3 cases had work permits showing their job position as technical workers with the title of medical equipment maintenance technician working at Hai Cat Medical Equipment Co., Ltd.

On the 5th, 7th and 9th floors of the building, there were about 2,000 medicine bottles with Chinese labels of unknown origin; some Viluta 600mg medicine boxes produced by VP Pharmaceutical Joint Stock Company, many unused Viluta and Avigly label stickers were used to stick on medicine bottles of unknown origin.

In addition, there are some types of medicine with old labels removed and new labels applied; many packages and medicine shells have been used; many types of medical machinery and equipment (Ozone blood purifier, high-frequency light machine, ultrasound, testing...) used for medical examination and treatment and extraction of medicinal herbs of unknown origin; many types of medicinal herbs of unknown origin and bags of oriental medicine that have been boiled.

The investigation determined that Hai Cat Medical Equipment Company Limited was established in 2018. Bach Giai General Clinic under this company has a license to operate in the field of andrology. The owner and legal representative is Vu Thi Thao. Thao is the person who signed the lease contract for the building at 813-815 Giai Phong Street.

However, in reality, Lin Kai Yuan, Zhang Wei, Xu Hong Chuang, and Lin Yong Peng were the investors in opening the company and clinic; leading, operating, and directing the activities.

The subjects directly clocked in and paid employees, purchased medicine from China, printed fake labels, and directly implemented and directed employees to change labels.

The subjects frequently changed interpreters, strictly controlled the working positions of employees and the activities of the floors through the camera system; through the links to direct the implementation. The monthly revenue of the company and clinic was billions of dong but did not match the financial report data.

Working with VP Pharmaceutical Company, the company representative confirmed that they did not sell products to Bach Giai General Clinic; Viluta at the clinic is a fake drug, not a drug produced by VP Pharmaceutical Company.
