Proposal to abolish 9 Decisions of the Prime Minister on land

The Ministry of Finance said that the drafting of the decision aims to terminate the validity of legal documents with contents that are no longer consistent with the provisions of the 2024 Land Law and its implementing guidelines (effective from August 1, 2024) but there is no legal basis to determine the expiration of validity according to the provisions of the Law on Promulgation of Legal Documents, in order to ensure the publicity and transparency of the legal system.

The draft proposes to abolish all 9 Decisions of the Prime Minister, including:

1. Decision No. 44/2010/QD-TTg dated June 10, 2010 of the Prime Minister on exemption of land use fees and land rental fees for construction of auxiliary works of national highways.

2. Decision No. 57/2010/QD-TTg dated September 17, 2010 of the Prime Minister on exemption of land rent for projects to build a reserve warehouse of 4 million tons of rice, corn, cold storage for preserving aquatic products, vegetables and fruits and temporary storage warehouse for coffee according to the planning.

3. Decision No. 33/2011/QD-TTg dated June 10, 2011 of the Prime Minister on exemption of land use fees for fishing households and people living on rivers and lagoons who move to resettle in resettlement areas and points.

4. Decision No. 48/2012/QD-TTg dated November 1, 2012 of the Prime Minister on amending and supplementing Decision No. 204/2005/QD-TTg dated August 15, 2005 of the Prime Minister on adjusting and supplementing the subjects and mechanisms for borrowing capital for housing construction under the program for building residential clusters, routes and housing in areas frequently flooded in the Mekong Delta.

5. Decision No. 11/2015/QD-TTg dated April 3, 2015 of the Prime Minister stipulating exemption and reduction of land use fees when recognizing land use rights, house ownership rights and other assets attached to land for households and individuals for residential land allocated (granted) without proper authority before October 15, 1993 in areas with difficult or especially difficult socio-economic conditions, border areas and islands.

6. Decision No. 22/2020/QD-TTg dated August 10, 2020 of the Prime Minister on reducing land rent in 2020 for subjects affected by the COVID-19 epidemic according to Resolution No. 84/NQ-CP dated May 29, 2020 of the Government.

7. Decision No. 27/2021/QD-TTg dated September 25, 2021 of the Prime Minister on reducing land rent in 2021 for subjects affected by the COVID-19 epidemic.

8. Decision No. 01/2023/QD-TTg dated January 31, 2023 of the Prime Minister on reducing land and water surface rents in 2022 for subjects affected by the COVID-19 pandemic.

9. Decision No. 25/2023/QD-TTg dated January 3, 2023 of the Prime Minister on reducing land rent for 2023.
