Continuing the program of the 7th Session of the 15th National Assembly, on the afternoon of May 20, General To Lam, Minister of Public Security, presented the Government's proposal on the draft Law amending and supplementing a number of articles of the Law on Security Guards.
According to Minister To Lam, the Law on Guards was passed by the 14th National Assembly on June 20, 2017, and took effect from July 1, 2018. After 5 years of implementation, in addition to the positive results achieved, the process of implementing the law has encountered a number of difficulties and shortcomings that need to be amended and supplemented, focusing on the following groups of issues: Guard subjects; guard measures and regimes; duties and powers of the guard force.
In the draft Law amending and supplementing a number of articles of the Law on Guards, it is noteworthy that the guard subjects are the Standing Member of the Secretariat, the Chief Justice of the Supreme People's Court, and the Chief Prosecutor of the Supreme People's Procuracy, who have been identified as senior leaders of the Party and State according to Conclusion No. 35-KL/TW dated May 5, 2022 of the Politburo on the list of titles, leadership positions and equivalents of the political system from the Central to the grassroots level.
The draft law also clearly stipulates the group of subjects guarded as especially important events; supplements the regime, measures of guarding and the duties and powers of the guard force.
The draft law consists of 2 articles, of which Article 1 proposes to amend and supplement 15/33 articles of the Law on Security Guards; Article 2 is on the effective date.
In a summary report on the review of the draft Law amending and supplementing a number of articles of the Law on Guards, Chairman of the National Assembly's Committee on National Defense and Security Le Tan Toi said that the review agency agreed with the necessity of amending and supplementing a number of articles of the current Law on Guards for the reasons stated in the Government's submission.
The National Assembly's Committee on National Defense and Security found that the provisions in the draft law are consistent with the Party's guidelines and viewpoints, and the provisions of the 2013 Constitution, and basically ensure feasibility and consistency in the legal system. However, the draft law has many contents related to the provisions of the Law on People's Public Security, the Law on Mobile Police, the Law on Management and Use of Public Assets, etc. It is recommended that the provisions in the draft law be continued to be reviewed to ensure consistency in the legal system.
The draft law has amended and supplemented a total of 15/33 articles of the current Law on Security Guards, focusing on major policies such as amending and supplementing security subjects, security measures, powers of security forces, regimes and policies for security work.
The National Defense and Security Committee agrees with the scope of the amendments and supplements stated in the submission and adjustments of the draft law; consistent with the purpose and viewpoint of law-making as an institution of the Party's guidelines and viewpoints, removing difficulties and obstacles, ensuring consistency and unity in the legal system and meeting the requirements of protecting national security and ensuring social order and safety.
Regarding the addition of the guard subjects to the Standing Committee of the Secretariat, the Chief Justice of the Supreme People's Court, and the Chief Prosecutor of the Supreme People's Procuracy (Points b and c, Clause 3, Article 1), the National Defense and Security Committee agrees with the addition of the guard subjects to the Standing Committee of the Secretariat, the Chief Justice of the Supreme People's Court, and the Chief Prosecutor of the Supreme People's Procuracy in order to promptly institutionalize the Party's regulations.
