Ensuring land fund for investment attraction and socio-economic development

Prime Minister Pham Minh Chinh requested provinces and cities to synthesize and include land use indicators in provincial planning, submit for appraisal and approval according to the provisions of law.

Prime Minister Pham Minh Chinh has just signed and issued Official Dispatch No. 360/CD-TTg on the results of implementing assigned land use planning targets; synthesizing land use targets that need to be adjusted in the land use planning until 2030 and the land use plan until 2025.

The dispatch stated that implementing Resolution No. 39/2021/QH15 of the National Assembly, the Prime Minister issued Decision No. 326/QD-TTg on allocating national land use targets for the 2021-2030 period, with a vision to 2050, and the 5-year national land use plan for 2021-2025.

However, up to now, some provinces and centrally-run cities have issued documents requesting adjustments to land use planning targets until 2030 and requesting adjustments to land use planning targets until 2025, focusing on land use targets for industrial parks, traffic land, sports land, energy project land, high-tech zone land, rice-growing land, 3 types of forest land, national defense land, and security land.

At the same time, Article 15 of Resolution No. 81/2023/QH15 of the National Assembly on the national master plan for the 2021-2030 period, with a vision to 2050, requires that plans in the national planning system that have been decided or approved by competent authorities in accordance with the provisions of the Law on Planning must be reviewed and adjusted appropriately to ensure consistency with the national master plan.

To protectsureLand fund for investment attraction, socio-economic development to meet the requirements of industrialization and modernization of the country, development of a synchronous infrastructure system, and promotion of land resources, the Prime Minister requested the Chairmen of the People's Committees of provinces and centrally run cities to urgently direct competent agencies based on the National Master Plan for the period 2021-2030, vision to 2050, the National Land Use Plan for the period 2021-2030, vision to 2050 and the requirements of local socio-economic development, to synthesize and include land use indicators in provincial planning, submit for appraisal and approval according to the provisions of law; take full responsibility for the synthesized data, the proposal to include land use indicators in the planning and the exploitation, effective use, and saving of land funds according to the planning.

Deploy programming to approve the 5-year Land Use Plan 2021-2025 at the provincial level; review and adjust annual land use planning and plans at the district level to serve as a basis for land allocation, land lease, and permission to change land use purposes to meet socio-economic development needs.

Based on the land use quota allocated by the Prime Minister in Decision No. 326/QD-TTg, provinces and cities shall review and evaluate the implementation results (including: occupancy rate of industrial parks, clusters, economic zones, high-tech zones; land use rate for production and business purposes, infrastructure development, etc.), in case the land use demand arises (increases or decreases) compared to the land quota allocated by the Prime Minister, send it to the Ministry of Natural Resources and Environment and the Government Office before May 20, 2023 for synthesis and reporting to the Prime Minister.

Based on the synthesis of reports on land use needs of localities, the Ministry of Natural Resources and Environment shall preside over and coordinate with relevant ministries and branches to synthesize and advise the Government to submit to the National Assembly for consideration and adjustment of the National Land Use Plan for the period 2021-2030, with a vision to 2050 and the 5-year National Land Use Plan 2021-2025 at the meeting in October 2023.

Ministers of the ministries of Planning and Investment, Agriculture and Rural Development, Construction, Transport, Minister, Head of the Government Office and relevant agencies coordinate with the Ministry of Natural Resources and Environment to report to the Government, submit to the National Assembly for consideration and adjustment of national land use planning and plans until 2030.

Ministers, heads of ministerial-level agencies, government agencies, and Chairmen of People's Committees of provinces and centrally run cities are responsible to the Prime Minister and the law for organizing the implementation of this telegram.
