The Standing Secretariat signed Regulation No. 146 stipulating the functions, tasks, powers, organizational structure, and working relationships of the Party Delegation and the Party Executive Committee at the provincial level.
The Secretariat's regulations clearly state that the Party Delegation and the Party Executive Committee at the provincial level are party organizations established by the Standing Committee of the Provincial Party Committee and the City Party Committee directly under the Central Committee, under the direct and regular leadership of the Standing Committee of the Provincial Party Committee.
The Party Delegation and the Party Executive Committee at the provincial level perform the function of leadership and direction for the People's Council, People's Committee, People's Court, People's Procuracy, Vietnam Fatherland Front Committee, socio-political organizations, unions of literary and artistic associations, unions of scientific and technical associations at the provincial level according to the provisions of the Party Charter and regulations and instructions of the Central Committee.
Regarding the organizational structure, members of the Party Delegation and the Provincial Party Executive Committee are appointed by the Standing Committee of the Provincial Party Committee based on the proposal of the Party Organization Committee, the Party Delegation and the Provincial Party Executive Committee.
Accordingly, members of the Provincial People's Council Party Delegation include: Chairman, Vice Chairmen of the People's Council, Heads of People's Council Committees, Chief of Office of the National Assembly and People's Council Delegation. The Chairman of the People's Council acts as Secretary of the Party Delegation, and a Vice Chairman of the People's Council acts as Deputy Secretary of the Party Delegation.
Members of the Party Executive Committee of the Provincial People's Committee include: Chairman, Vice Chairmen of the People's Committee, Director of the Department of Home Affairs, Chief of Office of the People's Committee. The Chairman of the People's Committee acts as Secretary of the Party Executive Committee, and a Vice Chairman of the People's Committee acts as Deputy Secretary of the Party Executive Committee.
Members of the Party Delegation of the Vietnam Fatherland Front Committee at the provincial level include: the Chairman, Vice Chairmen of the Vietnam Fatherland Front Committee (who are Party members), heads of socio-political organizations, members of the provincial Party Executive Committee participating in the Vietnam Fatherland Front Committee, the head of the committee is responsible for advising on organizational work, cadres (who are Party members) of the specialized agency of the Vietnam Fatherland Front Committee. The Chairman of the Vietnam Fatherland Front Committee is the Secretary of the Party Delegation, a Vice Chairman of the Vietnam Fatherland Front Committee is the Deputy Secretary of the Party Delegation.
Members of the Party Executive Committee of the Provincial People's Court include: Chief Justice, Deputy Chief Justices, Head of the Organization and Personnel Department. The Chief Justice serves as Secretary of the Party Executive Committee, and a Deputy Chief Justice serves as Deputy Secretary of the Party Executive Committee.
Members of the Party Executive Committee of the Provincial People's Procuracy include: the Chief Prosecutor, Deputy Chief Prosecutors, and Head of the Organization and Personnel Department. The Chief Prosecutor serves as Secretary of the Party Executive Committee, and a Deputy Chief Prosecutor serves as Deputy Secretary of the Party Executive Committee.
Members of the Party Delegation of provincial-level socio-political organizations include: Chairman, Vice Chairmen and Heads of Departments (offices) whose duties include advising on organizational and personnel work (who are Party members) of that organization. The Chairman acts as Secretary of the Party Delegation, and a Vice Chairman acts as Deputy Secretary of the Party Delegation.
The members of the Party Delegation of the provincial-level union of literary and artistic associations and the union of scientific and technical associations include: the Chairman, Vice Chairmen (who are party members) and Heads of departments (offices) responsible for advising on organizational and personnel work (who are party members) of that organization. The Chairman acts as Secretary of the Party Delegation, and a Vice Chairman acts as Deputy Secretary of the Party Delegation.
Regarding working principles, the Secretariat stipulates that the Party Delegation and the Provincial Party Executive Committee work according to the principles of democratic centralism, collective leadership, individual responsibility, and majority decision. For important work contents that exceed the authority, the opinion of the Standing Committee of the Provincial Party Committee must be sought.
When members of the Party Delegation and the Provincial Party Executive Committee have different opinions and cannot reach a consensus through discussion (the vote does not reach a majority), they must fully report those different opinions to the Standing Committee of the Party Committee.
The regulation also clearly states that the Party Delegation and the Provincial Party Executive Committee shall meet regularly once a month, with special and extraordinary meetings when necessary; meetings shall only be held when at least 2/3 of the members attend. The content of all meetings must be recorded in minutes, with conclusions and resolutions issued for circulation and implementation.
In case of necessity or emergency, when a meeting cannot be held, the opinions of party members and party executive committee members can be obtained in writing (except for personnel work).
