2 female "criminals" get bitter ending

In May 2021, Clark Material Handling Vietnam Co., Ltd. in Cam Phuc Commune (Cam Giang) discovered that many valuable forklift manufacturing components had been lost. The company's representative filed a report with the Investigation Police Agency (Hai Duong Provincial Police).

Through investigation, the authorities identified 4 subjects from Cam Giang district, including: Nguyen Dinh Long (born in 1958, residing in Luong Dien commune), Pham Van Tru (born in 1965, residing in Cam Dong commune), Vu Thi Lan (born in 1969, residing in Cam Phuc commune) working as security guards at Clark Material Handling Vietnam Co., Ltd., together with Pham Van Thuan (born in 1981, residing in Tan Truong commune) stole the above assets.

Fearing criminal prosecution, these people sought help from someone to “fix the case”. Through acquaintances, the four subjects Long, Tru, Lan, and Thuan contacted Le Thi Lan (born in 1975, residing in Hong Nam commune, Hung Yen city) to ask her to “fix the case”. Lan agreed and then contacted Nguyen Thi Thanh Nga (aka Nguyen Thi Thanh Nhan, born in 1972, residing in Tien An ward, Bac Ninh city) to ask Nga to do this. Nga agreed and said that she had a wide network of relationships, knew many people in high positions and told Lan to ask “you guys” and then answer later.

A few days later, Nga informed Lan that she could influence the Hai Duong province prosecution agencies to help these people avoid criminal prosecution. At that time, Nga had not mentioned any costs. Upon hearing the news, Lan informed the four subjects that she agreed to accept the “case-fixing”, asking each person to prepare 1 billion VND to use when needed, and pledging that if they were not acquitted, she would return the money. All four agreed.

Nga and Lan asked these four people to prepare some gifts. Lan received 50 million VND from each person and said that this money was a gift and not included in the money to pay for the case.

The four people trusted her and transferred money to Lan many times, giving her a total of 4.4 billion VND in cash. Lan wrote a confirmation paper stating that she had received the money to "clear" these people. Lan transferred more than 3.95 billion VND to Nga and kept 450 million VND.

On July 27, 2021, the Investigation Police Agency (Hai Duong Provincial Police) initiated a criminal case on the crime of property theft that occurred at Clark Material Handling Vietnam Co., Ltd. After receiving the money, Nga used it for personal expenses.

On July 30, 2021, Nga called Lan to inform her that she could not "acquit" and discussed that if everyone agreed to "run the case" to apply a suspended prison sentence, then they would continue. continue to help. If it doesn't work, Nga will return the money to Lan. Hearing that, Lan went to meet the 4 people to discuss the above information. All 4 people agreed. Nga helped me get a suspended sentence. Nga promised to pay back if there was any remaining cost.

In September 2021, Long, Tru, Thuan, and Lan were prosecuted and temporarily detained by the Investigation Police Agency (Hai Duong Provincial Police) for theft. Afterwards, Thuan's family filed a complaint about Lan's behavior with the Investigation Police Agency (Hai Duong Provincial Police).

The "runner" received his sentence.

At the end of September, the People's Court of Hai Duong province opened a first-instance trial for Le Thi Lan and Nguyen Thi Thanh Nga on charges of fraud and property appropriation.

Ms. Nguyen Thi Thanh Minh, representative of the People's Procuracy of Hai Duong province, said that this was a case with accomplices in which Lan was the one who directly agreed to receive the amount of 4.4 billion VND from the victims, so she must bear criminal responsibility for the above amount. Nga was an accomplice with Lan and must be punished for appropriating more than 3.95 billion VND.

In court, Lan confessed honestly, repented, and voluntarily returned more than 2.2 billion VND to the victims, so she was given mitigating circumstances for her criminal liability. Defendant Nga was not given mitigating circumstances.

The defendants' actions are dangerous. The total amount of money the defendants have appropriated is 4.4 billion VND, infringing on the property rights of the victims.

Based on the nature, extent and conduct of the defendants in the case, the Trial Panel sentenced Le Thi Lan to 13 years in prison and Nguyen Thi Thanh Nga to 16 years in prison for fraud and appropriation of property. In addition, the defendants must also bear civil liability to return the amount of money they have appropriated to the victims.

Those who gave money to Lan to “fix the case” showed signs of bribery and bribery brokerage. However, Nga was the one who only received the money, so she did not commit the above two crimes.
