According to the indictment, Nguyen Thi An and Nguyen Thi Lanh did not have any professional qualifications in education, but in November 2022, they still opened a class to take care of children. The defendants rented a house in Van Diem village (Van Diem commune, Thuong Tin district, Hanoi) as a place to take care of children. From the time the class was opened until March 1, 2023, An and Lanh took care of 7 children.
In mid-February 2023, Ms. Phung Thi T. (born in 1981) was busy with work so she sent her son, Pham Tien D. (born September 11, 2021) to An and Lanh's childcare facility.
At around 7:30 a.m. on February 23, Ms. T. brought her children here. Two hours later, An and Lanh took the children into the bedroom, but D. ran out, stood at the door, and cried. Angry, Lanh carried D. into the bedroom and threw him onto the foam mattress on the floor, causing the child's head to hit the mattress.
Seeing the boy continue to cry, Lanh yelled, hit him, then left the boy lying there, and sat on the chair. At this time, An was in the bedroom, saw his colleague abusing the child but did not say anything. Seeing D. still crying, An went to continue to torture him.
At 4:30 p.m., the mother came to pick up her child and saw bruises on both of her child's ears. When Ms. T. asked the reason, Lanh said that D. fell into the toy basket.
Believing Lanh's words, Ms. T. took her child home. That evening, D. began vomiting. In the following days, Ms. T. and her husband continued to take their child to An and Lanh's care facility.
On March 26, Lanh was busy with work so she took a day off, leaving An to look after the children. At 9:30 a.m. the same day, An saw D. crying, so he picked her up with both hands and threw her on the floor, then kicked her in the stomach with his right foot and went into the kitchen.
When he turned around, An saw D. vomiting and scratching his face, so he called Lanh. Lanh told him to get water for him to drink, but D. could not drink because he was unconscious. An poured a cup of water on his face and slapped him to wake him up. Seeing that the victim was still unconscious, An called Ms. T. to come to the class. When the mother arrived, she saw her child was cold, with stiff limbs, eyes closed, and wet clothes. She and An immediately took the child to the emergency room.
That same afternoon, D. passed away at home. The forensic examination concluded that he died of irreversible circulatory and respiratory failure due to severe traumatic brain injury.
