According to the decision authorizing the district-level People's Committee in deciding land prices recently issued by the Hai Duong Provincial People's Committee, the district-level People's Committee is authorized to decide specific land prices for a number of cases until the 2013 Land Law expires.
Specifically, when the 2013 Land Law expires, the People's Committees of districts, towns and cities in the province will be allowed to decide on specific land prices for cases of changing land use forms, extending and adjusting land use terms of households and individuals.
The district-level People's Committee is also authorized to decide on the establishment of a land valuation council. The chairman of this council is the chairman of the district-level People's Committee; the standing member of the council is the leader of the district-level financial agency; council members include leaders of the natural resources and environment agency and related professional agencies, leaders of the People's Committee of the commune where the land is located, organizations with the function of consulting on land valuation or land price experts, etc.
Previously, the meeting of the National Assembly Standing Committee on the afternoon of June 13 considered the Government's proposal to allow the Land Law, Housing Law, and Real Estate Business Law to take effect from August 1, 2024. In particular, some transitional provisions in Articles 253 to 260 of the Land Law are allowed to take effect from January 1, 2025. After discussion, the National Assembly Standing Committee agreed to submit this issue to the National Assembly for consideration and decision.
Thus, if passed, the 2013 Land Law will expire on August 1, 2024.
