The Ministry of Home Affairs has issued Circular 04/2024/TT-BNV, which stipulates the civil servant quota ratio from August 15, 2024.
The Ministry of Home Affairs issued Circular 04/2024/TT-BNV dated June 27, 2024 amending and supplementing a number of articles of Circular No. 13/2022/TT-BNV dated December 31, 2022 of the Minister of Home Affairs guiding the determination of the civil servant rank structure, in which, the civil servant rank ratio from August 15, 2024 is specifically prescribed as follows:
Determining the structure of civil service ranks does not include officials and civil servants holding leadership and management positions. According to the circular, when determining the structure of civil service ranks of administrative agencies and organizations, officials and civil servants holding leadership and management positions are not included.
During the period of not yet implementing salary payment according to positions and titles according to Resolution No. 27-NQ/TW dated May 21, 2018 of the 7th Central Conference, term XII on reforming salary policy for cadres, civil servants, public employees, armed forces and employees in enterprises, cadres and civil servants holding leadership and management positions are allowed to take exams and be considered for promotion corresponding to the complexity of the leadership and management positions but are not included in the civil servant rank structure of the agency or organization.
Ratio of civil servant ranks of agencies, organizations, units under or directly under ministries and ministerial-level agencies
For department-level organizations and equivalent units under ministries and ministerial-level agencies:
+ Senior specialist and equivalent: maximum 40%;
+ Senior specialist and equivalent: maximum 40%;
+ Specialist and equivalent, officer and equivalent, employee and equivalent: percentage (%) of remaining ranks.
For organizations under or directly under the General Department:
+ For department-level organizations and equivalent under the general department: Senior specialist rank and equivalent: maximum 30%; Senior specialist rank and equivalent: maximum 50%; Specialist rank and equivalent, officer rank and equivalent, employee rank and equivalent: percentage of the remaining ranks.
+ For organizations directly under the General Department organized locally according to vertical sectors: Senior specialist and equivalent: maximum 40%; Specialist and equivalent, officer and equivalent, employee and equivalent: percentage of the remaining ranks.
Ratio of civil servant ranks of specialized agencies and administrative agencies and organizations under the Provincial People's Committee
For specialized agencies and administrative agencies and organizations under the People's Committees of centrally-run cities:
+ Senior specialist and equivalent: maximum 50%;
+ Specialist and equivalent, officer and equivalent, employee and equivalent: % of remaining ranks.
For specialized agencies and administrative agencies and organizations under the People's Committees of centrally-affiliated provinces:
+ Senior specialist and equivalent: maximum 40%; Specialist and equivalent, officer and equivalent, employee and equivalent: percentage of remaining ranks.
Ratio of civil servant ranks of specialized agencies and administrative agencies and organizations under the People's Committee at district level
Civil servants of specialized agencies and administrative agencies and organizations under the People's Committee at district level hold the ranks of specialist and equivalent, officer and equivalent, employee and equivalent in accordance with the standards and conditions of the job position.
Ratio of civil servant ranks of other agencies and organizations
For agencies and organizations established under the provisions of the Party and the law, assigned civil servant payrolls by competent authorities but not subject to the above items, the head of the civil servant management agency shall decide to apply the percentage of civil servant quotas prescribed in the above items in accordance with the functions, tasks and scale of operations of the agency employing civil servants.
