Creating consensus in compensation and property support when land is acquired

On the afternoon of January 19, the Standing Committee of the Hai Duong Provincial People's Council supervised the implementation of compensation and support policies for properties such as houses and construction works on land when the State reclaims land in the province.

At the conference, delegates analyzed specific difficulties and problems in compensation and support for properties such as houses and construction works on land when the State reclaims land in Hai Duong province and focused on discussing solutions to overcome them.

Concluding the supervision session, Chairman of the Provincial People's Council Le Van Hieu noted that the implementation of compensation and support policies for assets on land when reclaiming land in cases of violating constructions should be divided into groups and specific cases to facilitate site clearance. For non-violating constructions, they should be implemented in accordance with the provisions of law.

Land acquisition needs to be thoroughly publicized, creating consensus among the people, ensuring that people enjoy the highest policies according to the provisions of the law. Researching and promulgating policies on compensation and support for properties such as houses and constructions on land when the state acquires land in Hai Duong province must comply with the provisions of the law and be consistent with the reality of the province.

Comrade Nguyen Thi Ngoc Bich, Member of the Provincial Party Standing Committee, Permanent Vice Chairwoman of the Hai Duong Provincial People's Council, expressed concern about the fact that most districts, cities and towns have not yet invested in building resettlement areas for people whose land has been recovered and must be resettled.

Previously, speaking at the working session, Comrade Luu Van Ban, Member of the Provincial Party Standing Committee, Permanent Vice Chairman of the Provincial People's Committee, raised a number of difficulties in compensation and support for assets when land is recovered in the province, especially difficulties in supporting assets built on agricultural land, land that is not compensated (houses and constructions of people with violations). Most districts, cities and towns have not invested in building resettlement areas to serve the allocation of resettlement land to people whose land has been recovered and must be resettled.

Comrade Luu Van Ban, member of the Provincial Party Standing Committee, Permanent Vice Chairman of the Hai Duong Provincial People's Committee, said that site clearance in 2024 still has bottlenecks but is expected to be better implemented than in 2023.

Comrade Luu Van Ban said that although there are still difficulties and bottlenecks, the site clearance work in 2023 in Hai Duong province has achieved many outstanding results; it is forecasted that it will be implemented even better in 2024.

Faced with current difficulties, the People's Committee of Hai Duong province recommends that the Central Government promptly issue decrees guiding the Land Law (amended), which specifically stipulate the contents of compensation, support, resettlement, support for assets and works attached to recovered land and clearly stipulate the responsibilities of relevant professional agencies, organizations and individuals.

Director of the Department of Natural Resources and Environment of Hai Duong, Hoang Van Thuc, said that the department is seeking opinions for the second time on the draft amendments and supplements to a number of articles of the Regulations on compensation, support and resettlement when the state acquires land in the province, attached to Decision No. 37/2014/QD-UBND dated December 22, 2014 of the Provincial People's Committee.

Departments and branches continue to advise the Provincial People's Committee and Provincial People's Council to issue regulations or guidelines on mechanisms, policies, and conditions for using the budget allocated to the Land Development Fund to serve the work of site clearance, creating a clean land fund to auction land use rights for socio-economic development projects.

The Provincial People's Committee, relevant departments, branches and levels will continue to strengthen land management, inspection and examination, ensure the interests of people whose land is recovered, and speed up the implementation of projects.

According to the report of the People's Committees of districts and cities, in the period of 2021 - 2023, the whole province has a total of 211 projects and works implementing land acquisition and site clearance. Of which, 134 projects have completed land acquisition and site clearance, 77 projects and works are implementing site clearance. Nam Sach district has the largest number of land acquisition and site clearance projects with 44 projects.
