The promulgation of a law to regulate gender reassignment aims to specify the provisions of Article 37 of the Civil Code, to meet the practical needs of a group of subjects in society, and to carry out gender reassignment in accordance with the provisions of law.
National Assembly Delegate Nguyen Anh Tri, Hanoi delegation said: The construction of the draft Law dossier is to institutionalize the guidelines, policies and guidelines of the Party and State on ensuring and implementing human rights, implementing the provisions of the Civil Code and related laws on gender reassignment and personal rights of transgender people. The subject of regulation of the draft Law has changed, so the name of the draft Law on Gender Reassignment has been replaced by the name of the draft Law on Gender Reassignment as submitted to the National Assembly Standing Committee at the 22nd Session.
“There are two policies that address the rights and methods of recognizing a new gender. Specifically, the right to change the gender of citizens, citizens have the right to change their gender. At the same time, criteria are set for citizens to exercise their rights. Policy 2 is to recognize a new gender, different from the gender at birth, at the request of citizens with a new process and procedure consisting of 5 steps,” said delegate Nguyen Anh Tri.
The promulgation of a law to regulate gender reassignment aims to specify the provisions of Article 37 of the Civil Code, meeting the practical needs of a group of people in society, who are allowed to undergo gender reassignment in accordance with the law to live with their correct gender.
The National Assembly deputies' submission of proposals for law making is an exercise of the right to legislative initiative as prescribed in the Constitution, the Law on Organization of the National Assembly and the Law on Promulgation of Legal Documents.
