The National Assembly discussed the draft Law on Organization of People's Courts and the Law on the Capital.

The draft Law on Organization of People's Courts (amended) and the draft Law on Capital City (amended) are two important contents that will continue to be discussed by the National Assembly on the 8th working day, working program phase 1.

Today, the National Assembly continued to discuss the draft Law on Organization of People's Courts (amended) and the draft Law on Capital City (amended).

Continuing the working program of the first phase of the 7th Session of the 15th National Assembly, today, May 28, the National Assembly entered the eighth working day with many important contents on the draft Law on Organization of People's Courts (amended) and the draft Law on the Capital (amended).

It is expected that in the morning session, the member of the National Assembly Standing Committee and Chairman of the National Assembly's Judicial Committee will present a report explaining, accepting and revising the draft Law on Organization of People's Courts (amended). After that, the National Assembly will discuss in the hall a number of contents of this draft law with different opinions, before the submitting agency and the agency in charge of the review coordinate to explain and clarify a number of issues raised by National Assembly deputies.

The afternoon working program (broadcast live on Vietnam National Assembly Television) will continue with the partPresenting the report explaining, accepting and revising the draft Law on the Capital (amended) by the Member of the Standing Committee of the National Assembly, Chairman of the Law Committee of the National Assembly.

The National Assembly will discuss in the hall a number of contents with different opinions in the draft Law on the Capital (amended). After that, the submitting agency and the agency in charge of the review will coordinate to explain and clarify a number of issues raised by National Assembly deputies.

Previously, at the 6th session (October 2023), the National Assembly discussed and commented on the draft Law on the Capital (amended). Immediately after the session, the Standing Committee of the Law Committee closely coordinated with the drafting agency (Ministry of Justice), Hanoi city authorities and relevant ministries and agencies to organize research, absorb opinions of National Assembly deputies, revise the draft law and report, request initial instructions from the National Assembly Party Delegation, and report to the National Assembly Standing Committee at the 31st session (March 2024).

The draft Law on the Capital (amended) after being accepted and revised includes 7 chapters and 54 articles (5 articles less than the draft law submitted to the National Assembly at the 6th session, in which all 54 articles were accepted and revised, 7 articles were removed, and 2 new articles were added).

Regarding the Law on Organization of People's Courts 2014, after nearly ten years of implementation, it has made many important contributions to the judicial reform process, institutionalizing the innovation of the organization and operation of courts according to the Party's policy on building and perfecting the socialist rule of law state of Vietnam.

However, in addition to the achievements, there are still problems, shortcomings and unreasonableness: Awareness of the position and role of the court as "the trial agency, exercising judicial power" and the full determination of the functions, tasks and powers of the court; organization and independent operation according to the trial jurisdiction of the courts; organization of units and human resources to assist the Council of Judges of the Supreme People's Court, the Committee of Judges of the High People's Court; judges' terms of office and division of judge ranks; functions, tasks and composition of the National Council for Selection and Supervision of Judges; the regime of responsibility, discipline and discipline needs to be strengthened; a complete legal mechanism to build and deploy the e-Court; protection mechanism for judges and courts...

The court system is facing major challenges such as: increasingly high task requirements, increasing responsibilities; the number of cases to be resolved is increasing, with increasingly diverse and complex nature; the requirement to internalize international commitments of which Vietnam is a member, resolving cases with foreign elements gives rise to many new issues...

This situation requires further improvement in quality and efficiency of operations, promotion of digital transformation, and construction of e-Courts. Therefore, it is necessary to build a suitable legal corridor through amending the Law on Organization of People's Courts 2014, related laws, and arranging conditions to ensure that courts can fulfill their tasks.
