Despite many difficulties, the civil judgment enforcement sector of Hai Duong province always strives to overcome difficulties, deploys many synchronous solutions, and gradually improves the effectiveness of civil judgment enforcement work.

Solve many complex and long-term problems
After more than 1 year of organizing many meetings and working sessions, at the end of June 2020, the Provincial Department of Enforcement of Civil Judgments organized the enforcement and handover of the property, a 3-storey house with an area of 450 m2 in An Trung area, An Luu ward (Kinh Mon) to the auction winner. This case is quite complicated because when the person subject to enforcement voluntarily handed over the mortgaged property for the enforcement agency to handle, problems arose because the property was then used and managed by another person (not the plaintiff or defendant). The Provincial Department of Enforcement of Civil Judgments has repeatedly propagated, mobilized, and explained, but the family of the person using the property did not move or hand over the property to the auction winner. To oppose the enforcement agency, the person using the auctioned property even threatened the authorities, planted mines in the house, forcing the enforcement team to conduct a bomb and mine clearance.
Previously, many long-standing cases were also persistently resolved by the two-level THADS agencies.
The two-level THADS agency has assigned targets and tasks to each officer and enforcement officer; developed a plan to resolve cases for each conditional case. Regarding the enforcement, in addition to implementing strict steps in accordance with the provisions of the law, the THADS agency also promotes propaganda, effectively uses educational measures, and persuades litigants and their relatives to voluntarily enforce the judgment; resolutely organizes enforcement in cases of resistance and obstruction of judgment enforcement. Enforcement officers, secretaries and specialists regularly review and classify cases, ensuring the accuracy of the number of cases with conditions for enforcement and the number of cases without conditions for enforcement. In the process of resolving judgment enforcement, the two-level THADS agency always closely coordinates with relevant agencies such as courts, people's procuracies, police, etc. to remove difficulties and obstacles. From 2016 to present, the whole industry has issued enforcement decisions in 221 cases, of which 47 cases had the parties voluntarily execute the judgment, and the remaining 174 cases were safely and successfully enforced.
Promote administrative reform
Since 2017, the provincial Department of Civil Judgment Enforcement has applied the "one-stop" mechanism for 5 administrative procedures directly related to civil judgment enforcement work, including: civil judgment enforcement decision upon request; confirmation of civil judgment enforcement results; request for change of enforcement officer; request for exemption or reduction of civil judgment enforcement fees; request for exemption or reduction of civil judgment enforcement fees. The provincial civil judgment enforcement sector also deploys the service of receiving and supporting online civil judgment enforcement requests according to the decisions of the General Department of Civil Judgment Enforcement to guide and support litigants in exercising their right to request civil judgment enforcement in accordance with the content, decisions of the court, and the authority of the civil judgment enforcement agency in a convenient manner, saving time and costs.
Mr. Nguyen Van Tuan, Director of the Provincial Department of Judicial Enforcement, said that the Department has assigned officials and civil servants with solid professional qualifications and a good understanding of legal regulations to work directly at the online reception and support departments of the Judicial Enforcement Agencies at all levels. The unit has invested in machinery and equipped the "one-stop" department with material conditions. The address of the email box receiving documents at the "one-stop" department has been posted, introduced on the website of the Provincial Judicial Enforcement Agencies, and sent documents to the parties. Every year, the two-level Judicial Enforcement Agencies organize a competition registration campaign for all officials, civil servants, and public employees, linking the results of administrative reform tasks with emulation and reward work. The results of administrative reform tasks are a criterion for reviewing, evaluating, and rewarding each collective and individual... Up to now, 100% of administrative procedures in the field of Judicial Enforcement Agencies have been public and transparent; 100% of administrative procedures are resolved on time.
Despite many difficulties, the provincial THADS sector has strived to successfully complete its assigned tasks. From 2016 to present, the sector has handled 44,716 cases with a total amount of VND 4,348 billion 904 million; the annual case settlement rate has always reached 84 - 85%, exceeding the target assigned by superiors in both the number of cases and the amount of money, always being the locality in the top of the country in THADS. With these achievements, over the past 75 years, the provincial THADS sector has been honored to receive many certificates of merit from the President, the Ministry of Justice, and the Provincial People's Committee, and many collectives and individuals have been commended by the Prime Minister, the Ministry of Justice, the General Department of THADS, and the Provincial People's Committee.
