Expectation that the Land Law (amended) will contribute to creating resources for national development

According to the program of the 5th Extraordinary Session, the draft Land Law (amended) will be voted on and approved by the National Assembly on January 18.

Speaking on the sidelines of the 5th Extraordinary Session of the 15th National Assembly, many delegates highly appreciated the efforts and determination of the drafting agency, the reviewing agency and relevant agencies and organizations in the process of participating in drafting the Land Law (amended).

The draft law for amendments submitted to the National Assembly this time was prepared very carefully, thoroughly and cautiously. Reasonable comments from National Assembly deputies, experts, scientists, relevant agencies and organizations, and opinions from voters and people nationwide were listened to and fully absorbed.

Delegate Hoang Van Cuong (Hanoi) said that after the 6th Session of the 15th National Assembly, the draft Land Law (amended) still had many options for selection, showing that the delegates listened to the people's opinions and raised issues that needed to be discussed. However, after a short time, issues that had many different opinions before were highly agreed upon between the drafting agency, the agency submitting to the government and the reviewing agency, the National Assembly.

Delegate Nguyen Dai Thang (Hung Yen) assessed that the draft Land Law (amended) submitted to the National Assembly for consideration at the 5th extraordinary session was relatively complete, meeting the requirements and practical demands, basically overcoming the limitations of the draft Land Law (amended) submitted to the National Assembly for comments at the 6th session, and meeting the conditions to be submitted to the National Assembly for consideration and approval at the 5th extraordinary session.

To further perfect the draft law, delegate Nguyen Dai Thang noted the rights and obligations of economic organizations and public service units using land leased by the State and collecting annual fees.

Clause 2, Article 34 of the draft law stipulates that "Public service units that are leased land by the State and collect annual land rents that are not in the case of using land to invest in construction and business of infrastructure of industrial parks and industrial clusters as prescribed in Article 202 of this law shall have the rights and obligations as prescribed in Clause 1 of this Article, except for the right to sell, the right to mortgage and the right to contribute capital with assets attached to land and the right to lease in the lease contract".

The delegate analyzed that the regulation that public service units when choosing the form of land lease with annual payment are not allowed to sell or mortgage assets attached to the land is reasonable and consistent with the preservation of land assigned by the State for public service units to use; it prevents assets from being auctioned if mortgaged.

However, delegate Nguyen Dai Thang suggested that the agency in charge of drafting the study could consider allowing public service units to contribute capital with assets attached to leased land in the direction of detailed regulations and conditions for capital contribution to create conditions and reduce financial pressure for public service units, especially autonomous public service units.

Delegate Pham Van Hoa (Dong Thap) said that the draft Land Law (amended) had a very elaborate and careful drafting, reception and revision process, especially during the process of building the draft law, there was a Resolution of the National Assembly Standing Committee on widely collecting opinions from all walks of life.

“This is a large and especially important bill, closely related to and directly affecting all people. The content of the draft law overcomes many problems and difficulties arising in the implementation of the 2013 Land Law. Determining that this is a law governing other laws, it is extremely important and necessary for the National Assembly and the National Assembly Standing Committee to spend a lot of time discussing it carefully and objectively with the participation and contributions of many delegates, experts, scientists and especially soliciting public opinions,” the delegate emphasized.

According to the delegate of Dong Thap province, the content of comments on the draft law has been collected, received and explained very carefully and elaborately by the responsible agencies, showing the spirit of openness and determination of the Drafting Committee and the Government; the drastic involvement from the beginning of the National Assembly Standing Committee to ensure the highest quality of the draft law.

Through discussion, opinions analyzed and clarified the options with different viewpoints and basically agreed on the major and key contents of the draft law. Next, the National Assembly Standing Committee, based on the comments of National Assembly deputies at the discussion session of the 5th Extraordinary Session, continued to absorb, explain, revise and perfect the draft law to ensure the highest quality before submitting it to the National Assembly for consideration and approval.

National Assembly deputies assessed that, up to this point, the draft Land Law (amended) has been improved and improved in quality. The drafting agency and the reviewing agency, in the process of receiving and revising, have listened carefully and carefully selected the reasonable comments of National Assembly deputies, experts, scientists, relevant agencies and organizations, and the opinions of voters and people nationwide. Major issues, difficult issues and issues with different opinions have been received and explained very carefully and satisfactorily.

Many delegates expressed their confidence and expectation that the Land Law (amended) will be considered and passed at the 5th Extraordinary Session with a high rate of consensus and approval, meeting the requirements, creating resources for national development...

In that spirit, in order for the Land Law (amended) to come into effect soon, according to delegates, the Government and relevant ministries and branches need to pay attention to promptly issuing decrees and documents providing detailed instructions for the implementation of the law; avoiding the situation where the law has to wait for a decree.

In addition, the dissemination and propaganda work on new points of the Land Law (amended); the key contents of the law to people and businesses also need to be strengthened and innovated so that those affected by the policy can grasp and comply with the regulations...
