Proposal to postpone the passage of the revised Land Law

Some people suggested that the National Assembly consider not passing the amended Land Law at the end of 2023 session but postpone it to have more time to complete it.

The above content was stated by the Vietnam Fatherland Front in the report on the results of collecting public opinions on the draft revised Land Law, dated March 20.

According toMTTQ, some opinions say that this amendment to the Land Law needs more time. The recent process of collecting opinions was still rushed, "inevitably formalistic" in many localities and units. When there is more time to research, absorb, and perfect, the amended law "will be truly high quality and effective".

According to the Vietnam Fatherland Front's Legal Democracy Advisory Council, the draft law has more than 50 articles authorizing the Government and the Ministry of Natural Resources and Environment to specify in detail, including the content of restricting citizens' rights that must be regulated by law. That is Clause 5, Article 66, which stipulates "criteria and decisions on delimiting areas with restricted access to land according to land users related to national defense and security".

The Council recommends that the drafting committee overcome the situation of delegating too much legislative authority in a law. Delegation only assigns detailed regulations on a point or a clause in a law and must clearly define the scope and content of the delegation.

According to the report of the Front, the content of Chapter VI of the draft on land recovery and land requisition has received special attention from the people with nearly 660,000 comments. Among them, there is a suggestion to separate the purpose of land recovery for national and public interests from the purpose of socio-economic development. In the case of land recovery for urban and commercial housing projects, investors need to negotiate prices with the people.

Chapter VII on compensation, support and resettlement when the State reclaims land received nearly 900,000 comments. Among them, there was a suggestion to study and supplement "the approval of compensation, support and resettlement plans must be carried out before the decision to reclaim land is made"; it was suggested to stipulate the compensation land price according to the market price at the time of reclamation instead of at the time of approval.

The Vietnam Fatherland Front said that from January 3 to March 15, the Front received 8.36 million comments from the people on the draft. Some comments were very enthusiastic, dozens of pages long, on all contents. Some organizations and individuals sent comments many times during the consultation period.

As planned, the Government will submit the bill to the National Assembly for comments for the second time at the 5th session (opening in May) and consider approval at the session at the end of this year.
