Do not consider criminal responsibility for 1 minister, many deputy ministers of Viet A department

Regarding the Viet A case, the Supreme People's Procuracy believes that the Investigation Agency's failure to consider criminal responsibility for one minister and many deputy ministers is appropriate.

According to the indictment, the investigation process of the case Viet A and 38 defendants in the case all confessed their crimes and those of their accomplices, actively cooperating with the investigation agency to clarify the nature of the case.

The defendants voluntarily paid money or influenced their families to pay money and assets to remedy the consequences. Specifically, Chairman of Viet A Phan Quoc Viet paid 200 million VND; Vu Dinh Hiep (Deputy General Director of Viet A) paid 25 million VND. Mr. Phan Quoc Viet submitted a request to use his money and assets that are being temporarily held and seized to remedy all the consequences of the case.

Defendant Trinh Thanh Hung (former Deputy Director of the Department of Science and Technology) recovered 8 billion VND and 8 savings books worth more than 3.9 billion VND. Former Minister Nguyen Thanh Long received a bribe of 2.25 million USD (equivalent to more than 51 billion VND), and recovered 2.22 million USD.

Mr. Nguyen Huynh (former Deputy Head of the Drug Price Management Department, Department of Drug Administration, Ministry of Health; former Secretary of the Deputy Minister of Health) received bribes of more than 53 billion VND, of which more than 49 billion VND was transferred to Mr. Nguyen Thanh Long and 4 billion VND was used personally. To date, 4 billion VND has been recovered.

Test of Viet A Company

Mr. Nguyen Nam Lien (former Director of the Department of Financial Planning, Ministry of Health) received a bribe of 100,000 USD (equivalent to more than 2.3 billion VND) and has recovered the entire amount. Mr. Nguyen Minh Tuan (former Director of the Department of Medical Equipment and Construction, Ministry of Health) received a bribe of 300,000 USD (equivalent to more than 6.9 billion VND) and has recovered the entire amount.

Mr. Chu Ngoc Anh (former Minister of Science and Technology) and Mr. Pham Cong Tac (former Deputy Minister of Science and Technology) caused damage to state property in the amount of 18.98 billion VND. Of which, Mr. Chu Ngoc Anh has recovered 1 billion VND; Mr. Pham Cong Tac has recovered 80 million VND.

In addition, a number of other defendants have also paid compensation.

Do not consider criminal liability for many individuals

Regarding some individuals at the Ministry of Science and Technology, including Mr. Huynh Thanh Dat (Minister of Science and Technology), Mr. Tran Van Tung (Deputy Minister of Science and Technology), Mr. Nguyen Dinh Hau (Director of the Department of Science and Technology), the Supreme People's Procuracy believes that the above individuals have related responsibilities in the management, rewards, and information and propaganda of the topic. However, they were not interfered or influenced by anyone; did not interfere, influence or collude or agree with any unit or individual; did not benefit, so the Investigation Agency did not consider criminal responsibility, and recommended handling according to regulations on the Party and government, which is appropriate.

Mr. Nguyen Truong Son (Deputy Minister of Health) signed 2 decisions to grant temporary and official circulation registration numbers for testing so that Viet A Company could produce and sell them commercially for illegal profits, causing damage to the State budget.

However, this is not the area that Mr. Nguyen Truong Son is in charge of, he did not collude or agree to benefit Viet A Company; there was no profit motive or other personal motive, Mr. Nguyen Truong Son was disciplined by the Central Inspection Committee and the Prime Minister.

The Supreme People's Procuracy believes that the investigation agency's application of legal provisions to exempt Mr. Nguyen Truong Son from liability is well-founded.

Regarding the case, Mr. Truong Quoc Cuong (former Deputy Minister of Health) was the Chairman of the Council for granting registration numbers for circulation, and lacked inspection in granting registration numbers for circulation, negotiated prices but did not collude; there was no profit motive, no personal motive. The main responsibility for the above violations belongs to Mr. Nguyen Thanh Long and the defendants, so according to the Supreme People's Procuracy, the investigation agency's failure to consider Mr. Cuong is appropriate.

For some individuals at the Ministry of Finance including: Mr. Do Hoang Tuan Anh (Deputy Minister), Mr. Nguyen Anh Tuan (Director of the Price Department) are related to Price Negotiation, checking the negotiated price but the successful negotiation is the responsibility of the Ministry of Health.

During the consultation inspection, the two men requested the Head of the Inspection Team to check the costs, not to collude, not to have any profit motive, to proactively declare, and to actively cooperate to clarify the nature of the case, so the Supreme People's Procuracy affirmed that the investigation agency's decision not to consider Mr. Do Hoang Tuan Anh and Nguyen Anh Tuan was appropriate.

For some individuals at CDC Hai Duong with different roles and tasks who participated in pre-paying testing and validating bidding documents to pay money to Viet A Company, Mr. Pham Duy Tuyen (Director of CDC Hai Duong) gave a total of 1.82 billion VND.

The Supreme People's Procuracy believes that these people are all subordinates who must follow the instructions of their superiors, did not know, did not collude with Viet A Company, did not know that Mr. Tuyen agreed on a percentage outside the contract, proactively reported, returned all the money received, and were disciplined by the Party, so the Ministry of Public Security's Investigation Agency divided responsibilities and exempted them from criminal liability, which is appropriate.

Regarding Ms. Nguyen Thi Hien (Chairwoman of the Board of Directors, General Director of VCHP Valuation Company) and Ms. Phi Thi Mai (Deputy General Director), who signed and issued the certificate without checking or reviewing, but did not collude to protect the unit price, and did not benefit, so according to the Supreme People's Procuracy, the Ministry of Public Security's Investigation Agency's division of responsibilities and exemption from criminal liability is appropriate.

During the investigation of the case, the Investigation Agency identified signs of violations by a number of individuals involved. However, because the investigation period had expired, the Investigation Agency separated information and documents related to the violations of these individuals to continue investigating and handling later.
