The Ministry of Public Security recommended that the Ministry of Science and Technology (MOST) and the Ministry of Health need to improve their capacity to control the power of leaders and the activities of specialized agencies after the Viet A incident.

In the conclusion of the investigation into violations in the Viet A case, the Ministry of Public Security's Investigation Police Agency pointed out the causes and conditions leading to the crime.

Specifically, according to the Investigation Agency, the Ministry of Science and Technology is lax and lacks supervision in the implementation of scientific research projects, especially national-level scientific research projects, in the following stages: Approving tasks, approving the host organization, individual project manager, and coordinating unit; funding, monitoring the use and payment of funds; managing the implementation of the project, and handling the results of the implementation of the project...

Due to the above mentioned laxity and lack of inspection and supervision at the Ministry of Science and Technology and the Ministry of Health, Phan Quoc Viet (Chairman of the Board of Directors and General Director of Viet A Company) took advantage of and colluded with leaders and officials of the Ministry of Science and Technology and the Ministry of Health to allow Viet A Company to be approved by the Ministry of Science and Technology to participate in research projects, use research results to prepare registration documents, be granted a temporary circulation registration number by the Ministry of Health, and officially register the test kit, turning the test kit from a research product owned by the State under the management of the Ministry of Science and Technology into property owned by Viet A Company, in violation of the law.

When Viet A Company commercially produced and sold test kits to the Ministry of Health, Phan Quoc Viet inflated the unit price structure but the Ministry of Health still negotiated and determined the price of 470,000 VND/test kit without basis.

When the Ministry of Health inspected the negotiated price, it was determined that Viet A Company had changed the production materials compared to the registration documents for circulation, but it did not issue an inspection conclusion or recommend any handling measures, leading to Viet A Company continuing to use the negotiated price with the Ministry of Health that had been inflated by Phan Quoc Viet, creating a price level to sell to units and localities, making illegal profits, causing especially serious damage to state assets, organizations and individuals.

In units and localities where violations occurred during the process of Viet A Company consuming test kits, medical supplies and biological products, the budget estimates were not promptly allocated; the professional qualifications of staff in bidding and purchasing medical equipment, supplies and biological products were still limited, especially in cases of natural disasters, epidemics and hostilities.

From the above reasons, the Investigation Police Agency of the Ministry of Public Security recommends that the Ministry of Science and Technology and the Ministry of Health need to improve their capacity to control the power of leaders, control the activities of specialized agencies in managing scientific and technological tasks, managing medical biological products, ensuring objectivity, transparency, and compliance with the law.

The Ministry of Science and Technology reviews the organizational structure and legal documents related to the field of science and technology to proactively or report to competent authorities to adjust and amend them to be consistent and in accordance with legal regulations in the direction of having a specialized agency to manage science and technology tasks; at the same time, strengthen inspection and supervision work, promptly detect and handle violations in the implementation of science and technology tasks.

The Ministry of Health shall strengthen inspection and supervision, promptly detect and handle violations in the issuance of registration numbers for circulation of medical biological products; coordinate with the Ministry of Finance and relevant agencies and units to take measures to manage prices of medical supplies and testing biological products.

The Ministry of Planning and Investment and relevant ministries and branches shall proactively or report to competent authorities for guidance on the implementation of shortened bidding in cases of natural disasters, epidemics, hostilities, etc., especially for large-value bid packages that have not been allocated a budget estimate for implementation, and guidance on determining contract value and negotiating contracts.

The People's Committees of provinces and centrally-run cities need to proactively inspect, review, and rectify the activities of public health units and facilities in bidding and purchasing medical equipment and supplies; train and improve professional qualifications in purchasing and bidding for staff of health units and facilities, and prevent violations and crimes.

The Investigation Police Agency of the Ministry of Public Security proposed that the Ministry of Finance consider administrative sanctions against the valuation company that committed violations as concluded in the case, suspend business, revoke the certificate of eligibility to conduct valuation services...

In addition to the defendants who have been prosecuted and proposed for prosecution, there are also a number of individuals whose related acts and violations are at different levels; there are individuals or acts that do not constitute a crime or do not have sufficient grounds to consider criminal liability or do not reach the level of criminal prosecution. The Investigation Police Department of the Ministry of Public Security concluded and issued a document recommending that the competent authorities strictly handle them according to the regulations of the Party and the Government.
