Having had conflicts before, when the wife or husband broke the law and had to serve a prison sentence, many people filed for divorce.
“Chance” of divorce
According to the investigation of Hai Duong newspaper reporter, in reality, the two-level courts in the province currently handle many divorce cases when the wife or husband is serving a sentence. In which, the majority of the plaintiffs are the wives, the defendants are the husbands who are serving a sentence.
Some judges who handle this type of marriage case said that through verification, many couples have had conflicts for a long time, they have to suppress the pain in their marriage, endure the bad treatment of the other party. Only when the wife or husband has served the sentence and no longer lives together, they dare to file a petition to the court as an "opportunity" for divorce.
The case of Ms. DHT (born in 2003, in Uong Bi City, Quang Ninh) is an example. In 2022, Ms. T. got married when she was quite young. The couple lived in Hai Duong City for a short time and then had conflicts. Ms. T. had to endure her husband often playing around and not caring about his family, but did not dare to divorce.
By 2023, her husband was a vagabond and addicted to drugs, so he was sentenced to prison by the court. Since then, she has returned to live with her parents in Quang Ninh. Determining that the relationship between husband and wife was no longer there and the conflict had become serious, she asked the court to grant her a divorce. She asked to raise her 3-year-old child and did not require her husband to fulfill his child support obligations because he was serving a prison sentence.
Ms. TTH (born in 1976 in Tan Truong commune, Cam Giang) and her husband got married in 1997. After 20 years of living together, the husband no longer cared about the family, and quarrels and arguments often occurred. Thinking of the love between husband and wife, Ms. H. often gave advice but her husband refused to change. She also tried to endure because she thought of her children. In June 2018, Ms. H.'s husband violated the law and was sentenced by the People's Court of Hai Duong province to 15 years and 6 months in prison for robbery. He is currently serving his sentence at Hoang Tien Prison (Ministry of Public Security). Ms. H. filed for divorce after discussing with her children.
Ms. BTTG's abuse by her husband, Tran Van Luan (37 years old, in Kim Thanh), caused a stir in public opinion in 2023. After Luan was prosecuted and temporarily detained by the Investigation Police Agency (Kim Thanh District Police) for abusing his wife and intentionally causing injury, Ms. G. filed for divorce from Luan, and the Kim Thanh District People's Court issued a decision recognizing the consensual divorce and the agreement of the parties without having to open a trial.
The judge of the Kim Thanh District People's Court went to the Kim Thanh District Police Detention Center to work with Luan. He agreed to divorce and give custody of their child to Ms. G.
Living is not happy, waiting is not happy either.
Ms. NTP married her husband, born in 1978 in Thai Thinh ward, Kinh Mon). The couple lived happily for a while, but then conflicts arose because her husband often played around, drank, and gambled. When she reminded him, he cursed and beat her. The conflict lasted and became more serious when she discovered that her husband had sexually assaulted her stepdaughter in 2019 and was sentenced to 19 years in prison by the People's Court of Hai Duong province.
Currently, Ms. T.'s husband is serving his prison sentence at Hoang Tien Prison. Although he wanted to work directly with her, she determined that the conflict between the two sides was very serious, she did not want to see him so she refused. She asked the court to resolve the divorce and the Kinh Mon Town People's Court accepted her divorce from her terrible husband.
Judge Doan Thi Thuy, People's Court of Cam Giang district, said that through the statements of the divorce petitioners whose husbands or wives were serving sentences, most of them had reasons for conflicts before the illegal acts occurred. The husband or wife did not abandon the other party when they accidentally or intentionally broke the law, but because they were too frustrated with their unhappy married life. Most of the husbands and wives who violated the law such as drugs, theft, public disorder, fraud, rape, sexual abuse, etc. also did not treat their wives well.
Most of the defendants serving their sentences in prison voluntarily declared, presented their views and agreed to divorce, child custody and submitted requests for trial in absentia at the public hearing of evidence and reconciliation.
In many divorce cases involving people serving prison sentences, many plaintiffs shared that they had to endure their spouses coming back to apologize dozens of times and still reoffending. There were also some parties who just stated in general that they were no longer compatible and did not want to wait for their partner to return from serving their sentence because they were disappointed that their partner had committed a crime with a bad character.
In some cases, divorce is no longer a sad thing, especially when the person has bravely removed the persistent "tumor" of an unhappy marriage...
