Hai Duong guides the implementation of the Housing Law and the Real Estate Business Law.

On the morning of October 22, at the Department of Construction, the People's Committee of Hai Duong province held a conference to disseminate and guide the 2023 Housing Law and the 2023 Real Estate Business Law.

Deputy Minister of Construction Nguyen Van Sinh and Vice Chairman of the Provincial People's Committee Tran Van Quan attended the conference.

Also attending were representatives of the Department of Housing and Real Estate Market Management, the Department of Legislation (Ministry of Construction); relevant departments, branches and units of the province; People's Committees of districts, towns and cities; representatives of a number of organizations and enterprises operating in the field of construction and real estate business in Hai Duong.

Speaking at the conference, Deputy Minister of Construction Nguyen Van Sinh emphasized that the research, development and promulgation of the Housing Law 2023, the Real Estate Business Law 2023 and detailed regulations have institutionalized the Party's guidelines and policies and the State's policies. Ensuring consistency and synchronization between the provisions of the Housing Law, the Real Estate Business Law and other relevant laws such as the Land Law, the Investment Law, and the Bidding Law. Promoting decentralization, delegation of authority, and strengthening the role of local authorities in housing management and real estate business activities. Strengthening administrative procedure reform, minimizing unnecessary investment and business conditions. Promptly removing existing problems and limitations in the real estate market over the past time.

According to Deputy Minister Nguyen Van Sinh, the 2023 Housing Law focuses on addressing eight major policy groups that run through the entire content of the law. These are policies on housing ownership; on the development and promulgation of the National Housing Development Strategy, housing development programs and plans; on housing development; on social housing; general policies on housing management and use; policies on management and use of apartment buildings; on finance for housing development and state management policies on housing.

The 2023 Law on Real Estate Business focuses on addressing major policy groups on real estate business, real estate services, and regulation for the stable and healthy development of the real estate market; and policies on state management in the field of real estate business.

At the conference, Vice Chairman of Hai Duong Provincial People's Committee Tran Van Quan asked delegates and investors to follow up, especially the new points of the law. For unclear contents or those with different interpretations, they should summarize and propose so that experts from the Ministry of Construction can directly guide them at the conference to facilitate the implementation process in the locality.

Regarding some contents that Hai Duong province is implementing, typically the province is researching and consulting the Provincial People's Council to issue a mechanism to support the implementation of construction investment projects according to the plan: in addition to supporting land fee exemption, it also supports site clearance costs and infrastructure investment costs in social housing land for both urban and suburban cases. This content needs to seek opinions, suggestions, and guidance from the Ministry of Construction and request the Ministry's experts to provide more information and practices of other localities. In addition, there are many other contents being implemented with different opinions, it is recommended that the leaders of the Department of Construction synthesize them for consultation with the leaders and experts of the Ministry of Construction.

Comrade Tran Van Quan suggested that after this conference, the departments, branches and localities of the province deploy and apply legal documents related to the Housing Law and the Real Estate Business Law. If any problems arise, promptly summarize them to the Department of Construction to consult with experts of the Ministry of Construction. If necessary, a written report should be sent and the Ministry of Construction and its departments and offices should be requested for guidance on implementation.

Also at the conference, leaders of the Department of Housing and Real Estate Market Management and the Legal Department disseminated and provided guidance on the 2023 Housing Law, decrees, decisions, and circulars detailing the law; introduced the basic contents of the 2023 Real Estate Business Law; the relationship of the above two laws with other laws; Decree No. 100/ND-CP dated July 26, 2024 of the Government regulating the development and management of social housing.

Previously, the National Assembly passed the Housing Law 2023 and the Real Estate Business Law 2023, which will take effect from August 1, 2024.
