Teachers in the non-public sector can register their business according to regulations to organize extra teaching outside of school.
According to Hai Duong Newspaper reporters, a number of organizations and individuals have registered their businesses related to the education sector at the Hai Duong Department of Planning and Investment. Many businesses have added business lines related to the education sector to organize extra classes.
This business registration is to implement Circular No. 29/2024/TT-BGDDT of the Ministry of Education and Training regulating extra teaching and learning, effective from February 14, 2025.
Freelance teachers or those teaching at non-public educational institutions can register their own business to organize extra classes.
Accordingly, registration of extracurricular tutoring business can be carried out in one of the following forms: business household, private enterprise, partnership, limited liability company or joint stock company.
According to Article 6 of Circular 29, organizations or individuals organizing extra-curricular teaching and learning activities outside of school with fees collected from students (collectively referred to as extra-curricular teaching establishments) must comply with the following requirements: Registering business according to the provisions of law; publicly announcing on the electronic information portal or posting at the place where the extra-curricular teaching establishment is located the subjects that are organized for extra teaching; the duration of extra-curricular teaching for each subject according to each grade level; the location, form, and time of organizing extra-curricular teaching and learning; the list of extra-curricular teachers and the amount of tuition collected before enrolling students in extra-curricular teaching and learning classes.
Circular 29 also clearly states that teachers who are teaching at schools are not allowed to teach extra classes outside of school for money from students that the teacher is assigned to teach by the school according to the education plan.
Teachers in public schools are not allowed to participate in the management and operation of extra-curricular teaching but can participate in extra-curricular teaching. However, teachers participating in extra-curricular teaching outside of school need to follow other procedures such as reporting to the principal about the subject, location, form, and time of extra-curricular teaching.
Circular 29 also stipulates that from February 14, only 3 groups of students are allowed to take extra classes at school if they want to register, including: students whose final semester subject results are not satisfactory; students selected by the school to nurture excellent students; final year students who voluntarily register to review for entrance exams and graduation exams according to the school's education plan. Schools are not allowed to collect money from these students.
Students who do not belong to the above 3 categories, if they have a need, will study outside of school according to regulations. The fee for extra-curricular study outside of school is agreed upon between parents, students and the tutoring facility.
Thus, from February 14, students in grades 6, 7, 8, 10, and 11 in Hai Duong will no longer have extra classes at school, but only final year students in grades 9 and 12 can have extra classes at school if needed.
While waiting for specific instructions on funding for teachers to tutor final year students, from February 14, many localities in the province will temporarily stop tutoring for 9th grade students.
According to the principals of many high schools, most 12th graders will register to review for the high school graduation exam. Therefore, in the immediate future, high schools will still organize extra classes in school to review for these students.
Extra classes in schools must comply with the provisions of Article 5 of Circular 29, each subject must not be taught more than 2 periods/week.
The circular also stipulates that no extra classes will be organized for primary school students, except in the following cases: art, physical education, and life skills training. According to the 2018 General Education Program, primary school students are still allowed to study 2 sessions/day at school.
It is known that many teachers who used to teach at home are no longer teaching. Many parents are worried and looking for teachers to teach their children. In particular, due to demand, some parents have registered their children for online tutoring with teachers.
