Clause 1, Article 5 of the Law on Prevention and Control of Harmful Effects of Alcohol and Beer 2019 strictly prohibits acts of inciting or forcing others to drink alcohol and beer.
At point b, clause 3, article 30 of Decree 117/2020/ND-CP, a fine of 1-3 million VND is imposed for forcing others to drink alcohol or beer. The fine is applied to administrative violations by individuals; for organizations committing the same violation, the fine will be twice the fine for individuals.
On the other hand, the person who forces others to drink alcohol may not know that his or her behavior is a violation. They think that it is normal to sit down and drink alcohol and invite each other to drink, or they themselves understand and are aware of their wrongdoing but deliberately ignore it and the person forced to drink alcohol does not react.
To end the situation of forcing others to drink alcohol, first of all, the person being forced to drink alcohol needs to have a clear and decisive attitude, proactively report to the authorities so that the authorities have a basis for handling, thereby deterring those who intend to force others to drink alcohol. At the same time, the authorities need to have more specific guidance and regulations on what is forced drinking alcohol so that people can understand it correctly and fully, and it is easy for the people to implement it, and it is also easy for the authorities to handle violations.
