Effectively combat crimes and violations of weapons and explosives

On the morning of April 2, continuing the program of the Legal Session, the National Assembly Standing Committee gave opinions on the Draft Law on Management and Use of Weapons, Explosives and Supporting Tools (amended).

Crimes using knives to commit crimes account for a very high rate.

Reporting at the meeting, Minister of Public Security To Lam said that at the 3rd session of the 14th National Assembly, Law No. 14/2017/QH14 on the management and use of weapons, explosives and supporting tools was passed, effective from July 1, 2018.

After 5 years of implementation, in addition to the achieved results, the process of implementing and enforcing the Law has encountered some shortcomings, limitations and difficulties, such as: currently, the rate of crimes using knives to commit crimes is very high, in many cases the subjects used sharp, pointed knives with high lethality, committing crimes in a very reckless manner, causing public outrage; however, the subjects could not be prosecuted for the act of illegally storing and using weapons because the current Law does not stipulate that knives are weapons.

In addition, the situation of subjects illegally using homemade guns and primitive weapons is very complicated, causing particularly serious and dangerous consequences like military weapons, but according to the provisions of the current Law, homemade guns and primitive weapons are not included in the list of military weapons.

Therefore, it is necessary to add regulations on homemade guns to the group of military weapons; highly lethal knives are primitive weapons; when a subject uses primitive weapons with the purpose of illegally infringing on human life and health, they are identified as military weapons in order to adjust the subject's perception and behavior, reducing the source of crime.

To reform and simplify administrative procedures, Minister To Lam emphasized the need to review procedures for granting licenses and certificates for weapons, explosives, explosive precursors, and supporting tools to reduce unnecessary paperwork and receive administrative procedure settlement records on the Public Service Portal; amend and supplement regulations on granting licenses to use weapons and tools in the direction of not specifying time limits and switching the issuance of registration certificates to issuance of use licenses.

In reality, many foreign agencies, organizations, businesses and individuals have the need to donate, present, and provide weapons and support tools to domestic agencies; however, the current Law strictly prohibits the donation, present, and provision of weapons and support tools. Therefore, in order to take advantage of foreign resources, it is necessary to supplement regulations allowing domestic agencies, organizations and businesses to receive weapons and support tools donated, presented, and provided by foreign agencies, organizations, businesses and individuals, etc.

According to Minister To Lam, the draft Law on Management and Use of Weapons, Explosives and Supporting Tools (amended) has many new points such as: reducing and simplifying documents and records prescribed in administrative procedures on weapons, explosives, explosive precursors, supporting tools for use, exploiting the National Database in performing administrative procedures in the electronic environment to reform administration, creating favorable conditions for agencies, organizations, businesses and people to serve the socio-economic development of the country; adding special subject interrogation seats to the concept of supporting tools; amending and supplementing a number of regulations on research, production, business, and use of industrial explosives to remove difficulties and obstacles for organizations and businesses serving socio-economic development...

In the preliminary review report of the Draft Law on Management and Use of Weapons, Explosives and Support Tools (amended), Chairman of the National Defense and Security Committee Le Tan Toi said that in order for the amendments and supplements to be comprehensive, appropriate, consistent, consistent, feasible and to limit multiple amendments and supplements, the Standing Committee of the National Defense and Security Committee requested the Drafting Committee to more comprehensively assess the achievements and difficulties, obstacles and shortcomings in organizing the implementation of the Law, to assess more carefully and have a political, legal and practical basis for supplementing some contents in the draft Law.

At the meeting, delegates discussed and clarified the necessity of amending the Law on Management and Use of Weapons, Explosives and Support Tools as well as the constitutionality and legality of the draft Law in the current legal system; the scope of regulation of the draft Law and the suitability, ensuring synchronization, unity and feasibility of the draft Law...

Best preparation for the upcoming 7th Session

In his closing speech at the April legal session, Vice Chairman of the National Assembly Nguyen Khac Dinh stated that the session had completed the entire agenda. The National Assembly Standing Committee assigned the Secretary General of the National Assembly and relevant agencies to promptly complete and issue concluding notices on each content.

The Vice Chairman of the National Assembly requested the Nationalities Council and the National Assembly Committees as well as the Government, relevant ministries and branches to continue to coordinate closely in the spirit of urgency, listening, sharing with each other, and taking responsibility for each other to create the highest consensus; promptly implement the conclusions of the National Assembly Standing Committee on draft laws, resolutions and projects, and best prepare for the upcoming 7th Session.

Vice Chairman of the National Assembly Nguyen Khac Dinh also noted the need to submit documents on time, especially for draft laws and resolutions expected to be commented on and approved according to the one-session process.

At this session, the National Assembly Standing Committee gave opinions on the following draft laws: Prevention and Combat of Human Trafficking (amended); Law on Notarization (amended); Law on People's Air Defense; Law on Management and Use of Weapons, Explosives, and Support Tools (amended); Law on Trade Unions (amended). These are the contents that will be presented to the National Assembly for first discussion at the 7th Session of the 15th National Assembly.

Along with that, the National Assembly Standing Committee also gave opinions on the draft Resolution of the National Assembly Standing Committee on job positions for full-time National Assembly deputies working at the Central level, cadres and civil servants under the management authority of the National Assembly Standing Committee.
