Regulation 148 - QD/TW on the authority of the head in temporarily suspending the work of subordinates when necessary... is an effective tool in personnel management.
Nearly two months before leaving us, on May 23, 2024, General Secretary Nguyen Phu Trong, on behalf of the Politburo, signed and issued Regulation No. 148-QD/TW, stipulating the authority of the head in temporarily suspending the work of subordinate officials in necessary cases or when there are signs of serious violations of Party regulations and State laws. The regulation consists of 4 chapters, with 12 articles, very specifically defining the scope of subjects, principles, bases, authority, responsibilities, time limits, records, and procedures in temporarily suspending the work of subordinate officials of the head.
Regulation No. 148 - QD/TW was issued and put into practice as an effective tool in the work of managing cadres, although temporary suspension from work is not a form of discipline, but only forcing cadres to stop performing assigned duties and tasks for a certain period of time. Therefore, this is a proactive solution of the Party to prevent manifestations arising in cadres and party members during the process of working and performing public duties.
Regulation No. 148 - QD/TW very specifically defines the basis for temporary suspension from work in necessary cases, including: Officials who commit violations of moral qualities and lifestyle, causing negative impacts, public outrage, and bad impacts on the reputation of organizations and individuals; officials who deliberately delay, shirk, or avoid responsibility, or do not perform work within their authority according to assigned functions and tasks; officials who commit acts of harassment, negativity, or cause trouble for people, businesses, agencies, and organizations in the process of performing official duties; officials who are being considered and disciplined but intentionally delay, avoid, or do not comply with the requests of competent authorities during the process of considering and handling their own violations, or take advantage of their position, authority, or influence or that of others to influence or cause difficulties in the consideration and handling; Cadres who have been disciplined by the Party in the form of warning or dismissal and are awaiting consideration and handling of their government positions, and if they continue to work, it will negatively affect the activities of the Party Committee, Party organization, agency, or unit.
The time limit for deciding to temporarily suspend a cadre from work in case of necessity according to Regulation No. 148-QD/TW is very short - no more than 15 working days, if it must be extended, it will not exceed 15 working days. The procedure for temporary suspension from work is also quick: When determining that there is a basis for temporary suspension from work as prescribed in Articles 4 and 5 of this regulation, no later than 2 working days later, the agency (department) organizing cadres (personnel) is responsible for advising the head to decide to temporarily suspend the cadre from work. No later than 2 working days later from the date of receiving the proposal from the agency (department) organizing cadres (personnel), the head decides to temporarily suspend the cadre from work.
The issuance of Regulation No. 148-QD/TW is very necessary to promptly resolve personnel issues in personnel work, thereby handling negative issues in socio-economic activities and other fields. Because the current demotion, dismissal, and dismissal of cadres, civil servants, and public employees must follow a process that requires many procedures and takes a lot of time. Meanwhile, according to Regulation No. 148-QD/TW, it will be very quick and timely.
This regulation of the Politburo has given the heads of agencies and units in the political system from the central to the grassroots level an important tool in the work of managing cadres to lead, operate activities, maintain discipline and order of the agency and unit. It requires the heads of agencies and units to be strict, disciplined, and exemplary, and for cadres, civil servants, and public employees to strive to cultivate and train their qualities and abilities to meet the requirements of performing public duties.
