The Government requires promoting production and business, disbursing public investment capital in 3 localities, including Hai Duong.

The announcement stated: On March 1, 2024, at the Government Headquarters, Deputy Prime Minister Tran Luu Quang chaired an online meeting with leaders of three provinces and cities: Hai Phong, Quang Ninh, Hai Duong on the situation and solutions to promote production and business, disbursement of public investment capital, infrastructure construction, import and export and other emerging issues in the area.

On behalf of the Government, the Prime Minister, Deputy Prime Minister Tran Luu Quang commended and highly appreciated the localities: Hai Phong, Quang Ninh, Hai Duong for drastically implementing many solutions to remove difficulties for businesses, focusing on improving connectivity between the three localities to promote mutual development, especially in terms of transport infrastructure, achieving many positive results in 2023 and the first two months of 2024.

To continue to remove difficulties, promote production and business, disburse public investment capital, build infrastructure, import and export, the Deputy Prime Minister requested localities to study, closely follow, and update mechanisms, policies, and legal regulations to promptly make appropriate adjustments in policy development and implementation at the local level, avoiding the situation where many documents and regulations have been issued but localities have not updated them in time.

Localities need to actively and proactively work specifically with ministries and agencies to promptly resolve difficulties and obstacles within their authority. In addition, localities also need to proactively advise and propose specific handling directions to ministries and central agencies; focus on researching and providing specific and accurate opinions on draft legal documents being developed and consulted by ministries and agencies, especially on draft Decrees guiding the Land Law (amended).

At the same time, the Deputy Prime Minister also requested the Ministry of Natural Resources and Environment and the Ministry of Construction to urgently develop and complete the Government's Decrees guiding the Land Law (amended) and the Housing Law (amended), and submit them to the Government for consideration and promulgation to soon put these two laws into practice.

Prioritize response and processing of 9 recommendations

Ministries and agencies, according to their assigned functions and tasks, shall promptly review, handle, guide and specifically respond to the unresolved recommendations of localities in the two Conclusion Notices No. 198/TB-VPCP dated May 31, 2023, No. 426/TB-VPCP dated October 20, 2023 and new recommendations arising at the meeting on March 1, 2024, avoiding general, unclear responses or only citing current legal regulations. Priority shall be given to responding to and handling the following 09 recommendations in March 2024:

Recommendation of Hai Duong Provincial People's Committee

(i) Regarding the proposal to supplement legal regulations on approving the policy of assigning the Provincial People's Committee to continue carrying out compensation procedures, site clearance and handover of land to investors implementing residential and urban area projects that have completed bidding to select investors on land plots of equitized enterprises as a basis for continuing to implement the project: Assign the Ministry of Natural Resources and Environment to study and respond in writing to Hai Duong province according to its authority.

(ii) Regarding the recommendation to guide and clarify the basis and method for calculating costs in the total investment of medical equipment procurement projects such as: project management costs, feasibility study report preparation costs, supervision costs, bidding document preparation costs, bidding document appraisal costs, bidding document evaluation costs and contractor selection result verification costs (in case the investor implements and in case the investor hires a consultant), contingency costs; guide and clarify the basis for competent authorities to decide on the design plan of the equipment procurement project (1-step or 2-step approval): Assign the Ministries: Planning and Investment, Health, Construction, Finance according to their functions and tasks to study and respond in writing to Hai Duong province.

(iii) Regarding the proposal for guidance on solutions to existing problems and difficulties in selecting investors to implement the Dai An II Residential Area Project: Assign the Ministry of Planning and Investment to study and respond in writing to Hai Duong province according to its authority.

The Deputy Prime Minister requested the Ministry of Planning and Investment to preside over and coordinate with the Government Office, relevant ministries, agencies and People's Committees of the provinces and cities of Hai Phong, Quang Ninh and Hai Duong to synthesize and report to the Prime Minister the results of the implementation of assigned tasks.

Recommendation of Hai Phong City People's Committee:

(i) Regarding the proposal for the Ministry of National Defense to promptly consider the plan to arrange and handle public assets to implement projects at Cat Bi International Airport, Hai Phong City; promptly submit to the Government for approval the National Defense Land Use Plan for the 2021-2030 period, with a vision to 2050: Request the Ministry of National Defense to study and respond in writing to Hai Phong City according to its authority.

(ii) Regarding the proposal to supplement transitional regulations for projects that have been approved for investment policies before the effective date of the Decree regulating sea encroachment activities as prescribed in Article 190 of the 2024 Land Law and have been assigned sea areas; to use the approved land use quotas in the Provincial Planning for the period 2021-2030, with a vision to 2050, without having to wait for the adjustment of the allocated land use quotas in Decision No. 326/QD-TTg: Assign the Ministry of Natural Resources and Environment to study and respond in writing to Hai Phong City according to its authority.

(iii) Regarding the proposal for the Ministry of Planning and Investment to appraise and promptly report to the Prime Minister for approval of the investment policy for the Trang Due 3, Nam Trang Cat, Giang Bien II industrial park projects and the projects of ports No. 9, 10, 11, 12 of Lach Huyen International Gateway Port: The Ministry of Planning and Investment is requested to preside over and coordinate with relevant agencies to promptly consider the proposal of Hai Phong City.

Recommendation of Quang Ninh Provincial People's Committee:

(i) Regarding the proposal for specific guidance on determining the number of employees in higher education institutions as a basis for implementing the Autonomy Project of Ha Long University: Assign the Ministry of Education and Training to research and respond in writing to Quang Ninh province.

(ii) Regarding the proposal to use regular expenditure funds to pay for the task of preparing specialized planning: Assign the Ministry of Planning and Investment to preside over and coordinate with the Ministry of Finance to research and respond in writing to Quang Ninh province according to its authority.

(iii) Regarding the proposal to report to the National Assembly for consideration and amendment of the provisions at Point g1, Clause 1, Article 3, Law No. 03/2022/QH15 dated January 11, 2022 regulating the Prime Minister's authority to approve investment policies for projects within protection zone II of relics recognized by competent authorities as special national relics on the List of World Heritage in the direction of "Assigning the Provincial People's Committee to decide on the Investment Policy for projects within the scope of protection zone II of relics recognized by competent authorities as special national relics on the List of World Heritage after receiving appraisal opinions from the Ministry of Culture, Sports and Tourism": Assign the Ministry of Planning and Investment to preside over and coordinate with the Ministry of Culture, Sports and Tourism to study and send a written response to Quang Ninh province.
