Circular 73 of the Ministry of Public Security regulates the patrol, control, and handling of violations of laws on road traffic order and safety by traffic police, including control through equipment and databases on traffic order and safety.
Recently, the Ministry of Public Security issued Circular No. 73/2024 with 5 chapters and 33 articles regulating the patrol, control, and handling of violations of laws on road traffic order and safety by traffic police, effective from January 1, 2025.
Accordingly, this circular stipulates the form, content, uniform, equipment, use of means, technical equipment, weapons, support tools and procedures for patrolling, controlling and handling violations of laws on road traffic order and safety by traffic police; mobilizing other forces in the People's Public Security to coordinate with traffic police to conduct patrols and controls when necessary.
Article 5 of the circular stipulates control through systems, means, equipment, and databases on road traffic order and safety.
Specifically, in addition to controlling through camera systems on traffic routes and in urban areas, traffic police can exploit data from journey monitoring devices and devices that record images of drivers.
Clause 2, Article 5 clearly states: “Control through the use of professional technical means and equipment, smart devices to support command and control of road traffic; exploit data from journey monitoring devices, driver image recording devices, and databases on road traffic order and safety”.
Traffic police units use professional technical equipment and means (including professional technical equipment systems for checking motor vehicle loads), smart devices to support command and control of road traffic; exploit data from journey monitoring devices, driver image recording devices, databases on road traffic order and safety to control, detect and handle violations of laws on road traffic order and safety, and other violations of laws according to regulations.
As a result, data collected from vehicles, equipment, and databases to detect and handle violations must comply with the provisions of the law on handling administrative violations, Decree No. 135/2021 regulating standards, management, operation, and use of data management systems for journey monitoring devices, driver image recording devices, and other relevant legal provisions.
In addition, according to Clause 3, Article 5, traffic police can control through receiving data collected from vehicle load control facilities.
Traffic police units assigned to patrol and control routes and areas are responsible for coordinating the reception of data collected from vehicle load control facilities installed on routes and areas according to the provisions of the Road Law and the Law on Road Traffic Safety and Order to control, detect and handle violations of laws on road traffic safety and order, vehicle load, and other violations of laws.
