What standards must commune-level officials and civil servants in Hai Duong meet?

Specific standards for each commune-level cadre position

Commune-level cadres must fully meet the standards prescribed in Clause 1, Article 7 of Decree No. 33/2023/ND-CP dated June 10, 2023, stipulating commune-level cadres, civil servants and non-professional workers at the commune level, in villages and residential groups.

Specifically, the general standards for commune-level cadres and civil servants are implemented according to current regulations of the law on cadres and civil servants, organizational regulations and regulations of the Party and socio-political organizations at the Central level. In addition, specific standards for each position must be met as follows:

1. The Secretary and Deputy Secretary of the Party Committee shall apply the standards prescribed in Clause 1, Article 8 of Decree No. 33/2023/ND-CP.

Specifically as follows:

a) Age: When holding a position for the first time, the candidate must be of working age for at least one full term (60 months), in special cases according to the decision of the competent authority managing cadres;

b) General education level: High school graduate;

c) Professional qualifications: University degree or higher. In case the Party Charter has provisions different from those in this Decree, the provisions of the Party Charter shall apply;

d) Political theory level: Graduated from secondary school or equivalent or higher. In case the Party Charter has provisions different from those in this Decree, the provisions of the Party Charter shall apply;

d) Other standards as prescribed by the Party and competent authorities for cadre management.

2. The Chairman and Vice Chairman of the People's Council; the Chairman and Vice Chairman of the People's Committee shall apply the standards prescribed in Clause 3, Article 8 of Decree No.33/2023/ND-CP.

Specifically:

a) Age: When holding a position for the first time, the candidate must be of working age for at least one full term (60 months), in special cases according to the decision of the competent authority managing cadres;

b) General education level: High school graduate;

c) Professional qualifications: University degree or higher. In case the law has provisions different from the provisions of this Decree, the provisions of that law shall apply;

d) Political theory level: Graduated from secondary school or equivalent or higher;

d) Other standards as prescribed by the Law on Organization of Local Government, relevant laws, regulations of the Party and competent agencies managing cadres.

3. The President of the Vietnam Fatherland Front Committee, the President of the Vietnam Women's Union and the President of the Vietnam Farmers' Union shall apply the standards prescribed in Clause 2, Article 8 of Decree No. 33/2023/ND-CP.

That is:

a) Age: According to the provisions of law, organization charter and regulations of central socio-political organizations;

b) General education level: High school graduate;

c) Professional qualifications: University degree or higher. In case the law or organization's charter has provisions different from those in this Decree, the provisions of such law or charter shall apply;

d) Political theory level: Graduated from secondary school or equivalent or higher. In case the law or organization's charter has provisions different from those in this Decree, the provisions of such law or charter shall apply;

d) Other standards as prescribed by the Party, central socio-political organizations and competent agencies managing cadres.

4. Secretary of Ho Chi Minh Communist Youth Union

a) Age: Holding the position not exceeding 35 years old;

b) General education level: High school graduate;

c) Professional qualifications: University degree or higher;

d) Political theory level: Graduated from secondary school or equivalent or higher. In case of not having the required political theory level, within 5 years from the date of the decision to approve the position of Secretary of the Ho Chi Minh Communist Youth Union by the competent authority, the candidate must complete the required political theory level;

d) Other standards as prescribed by the Party, the Charter of the Ho Chi Minh Communist Youth Union, the Regulations on cadres of the Ho Chi Minh Communist Youth Union of the Central Executive Committee, the competent authority for cadre management and relevant legal provisions.

5. Chairman of the Veterans Association

a) Age:

- The Chairman of the Veterans Association is a cadre, civil servant, public employee, worker or demobilized soldier: holding the position for the first time must be of working age for at least 1 full term (60 months) according to the provisions of the Law on Cadres and Civil Servants; the Labor Code; Government decrees and regulations of competent agencies of the Communist Party of Vietnam.

- The Chairman of the Veterans Association is a retiree or a recipient of monthly Social Insurance benefits, the age of first participation, re-election according to the instructions of the Vietnam Veterans Association.

b) General education level: High school graduate;

c) Professional qualifications: University degree or higher;

d) Political theory level: Graduated from secondary school or equivalent or higher;

d) Other standards as prescribed by the Party, the Charter of the Vietnam Veterans Association, instructions on implementing the Charter of the Vietnam Veterans Association, competent agencies managing cadres and relevant legal provisions.

Specific standards for each commune-level civil servant position

Commune-level civil servants must fully meet the standards prescribed in Clause 1, Article 7 of Decree No. 33/2023/ND-CP. In addition, each position must also meet the following specific standards:

1. The Commander of the Commune Military Command must also meet the standards prescribed by specialized military laws and the standards prescribed in Clause 2, Article 7 of Decree No. 33/2023/ND-CP. Specifically, he/she must be able to coordinate with units of the People's Army, the People's Police and other forces in the area to participate in building the all-people national defense, performing civil defense tasks; maintaining security, politics, social order and safety, protecting the Party, the government, State assets and protecting people's lives and assets.

2. Civil servants of the Office - Statistics; Land - Construction - Urban and Environment (for wards and towns) or Land - Agriculture - Construction and Environment (for communes); Finance - Accounting; Justice - Civil status; Culture - Society must meet additional standards as prescribed in Clause 2, Article 10 of Decree No. 33/2023/ND-CP. Specifically:

a) Age: 18 years of age or older;

b) General education level: High school graduate;

c) Professional qualifications: University degree or higher in a field of training appropriate to the job requirements of each commune-level civil servant position. In case the law has provisions different from the provisions of this Decree, the provisions of that law shall apply.

- Office and Statistics Civil Servants: University degree or higher in one of the following fields: office administration, state management, law, documents - archives, statistics, information technology, Party building and state administration suitable for the job position of the civil servant title.

- Civil servants of Land - Construction - Urban and Environment (for wards and towns), civil servants of Land - Agriculture - Construction and Environment (for communes): Graduated from university or higher in one of the following fields: land management, resource and environmental management, construction, traffic construction engineering, hydraulic construction engineering, urban and construction management, agriculture suitable for the job position of the civil servant title.

- Finance - Accounting civil servant: University degree or higher in one of the following majors: finance, accounting, auditing suitable for the job position of the civil servant title.

- Judicial and Civil Status Officer: University degree or higher in law.

- Cultural - Social Civil Servants: University degree or higher in one of the following majors: human resource management, insurance, social work; information - library, cultural management, cultural studies, Vietnamese studies, sports management suitable for the job position of the civil servant title.

- Civil servant, Commander of Military Command: Graduated from intermediate military vocational school or higher.
