The Ministry of Public Security proposed a fine of up to 5 million VND for those who do not participate in fire fighting and rescue when capable and under conditions.
The Ministry of Public Security is soliciting comments on a draft Decree regulating administrative penalties for violations in the fields of fire prevention, firefighting, rescue and relief. Notably, many proposed fines are higher (16-30 times higher) than current regulations.
Notably, the act of not participating in fire fighting, rescue, and relief when capable and under conditions is proposed to be fined from 3 to 5 million VND.
The above fines are also proposed for the following acts: Failure to fully prepare forces, means, water sources and other conditions for fire fighting, rescue and relief; failure to comply with orders to mobilize for fire fighting, rescue and relief; failure to participate in overcoming the consequences of a fire when requested by a competent person.
According to the draft, there will be a fine of 500,000 to 1 million VND for the following acts: Entering a fire-fighting area without permission from a competent person; a fine of 10 - 15 million VND for encroachment and placing obstacles that hinder the operation of fire-fighting equipment.
The act of obstructing fire fighting forces and equipment is proposed to be fined from 15 to 25 million VND.
A fine of 30 - 40 million VND is proposed for the following acts: Failure to build or maintain a road for firefighting vehicles; rendering a road for firefighting ineffective.
The proposed fine for false fire alarms, false rescue situations, and false rescue situations is 5 - 10 million VND.
In addition, the Ministry of Public Security proposed a fine of 5 - 7 million VND for the act of using fire sources, heat sources, equipment, and tools that generate fire or heat without ensuring a safe distance for fire prevention according to regulations.
The Draft Decree consists of 4 chapters and 41 articles, regulating administrative sanctions in the field of fire prevention, fire fighting, rescue and salvage, including: Administrative violations, forms, levels of sanctions, remedial measures for each administrative violation, authority to draw up records, authority to impose sanctions, specific fines for each position for administrative violations in the field of fire prevention, fire fighting, rescue and salvage.
Administrative violations in other state management fields related to fire prevention, fire fighting, rescue and relief that are not specified in this Decree shall be subject to the provisions of decrees on administrative sanctions in those fields.
In case of violations in the field of fire prevention, fire fighting, rescue and relief where the provisions of this Decree are different from those of other decrees on administrative sanctions in other fields, the provisions of this Decree shall apply.
